【摘要】："抗癌藥代購第一人"陸勇事件引發(fā)社會各界的廣泛關(guān)注,該事件不只涉及刑法問題,其背后透露出的發(fā)展中國家完善和實(shí)施藥品專利強(qiáng)制許可的必要性和緊迫性更值得學(xué)界深思。以印度作為發(fā)展中國家的代表,通過介紹藥品專利強(qiáng)制許可制度在主要發(fā)展中國家的發(fā)展和實(shí)踐,反思我國藥品專利強(qiáng)制許可制度的現(xiàn)狀,并為解決相關(guān)問題提出法律和政策思路,以期未來中國能真正建立起符合國情的藥品專利強(qiáng)制許可制度。
[Abstract]:The case of "the first person who purchased the first anticancer drug" has aroused widespread concern from all walks of life in the society. This incident involves not only the criminal law issue, but also the issue of criminal law. The necessity and urgency of perfecting and implementing compulsory licensing of drug patents in developing countries revealed behind it is worth thinking deeply. By introducing the development and practice of compulsory licensing system for drug patents in major developing countries, India as a representative of developing countries, this paper reflects on the current situation of compulsory licensing system for drug patents in China. In order to solve the related problems, the author puts forward some legal and policy ideas in order to establish a compulsory licensing system for pharmaceutical patents in the future.
