【摘要】：我國《著作權(quán)法》第三次修改是為主動(dòng)適應(yīng)我國社會(huì)面臨的新形勢(shì)而啟動(dòng)的一次全面修改,在修法中,應(yīng)立足我國國情和立法傳統(tǒng),著眼于我國的現(xiàn)實(shí)需求和長(zhǎng)遠(yuǎn)發(fā)展,既要特別注意到大陸法系崇尚保護(hù)權(quán)利人精神人格權(quán)利的立法邏輯起點(diǎn),亦要特別注意到英美法系崇尚保護(hù)權(quán)利人財(cái)產(chǎn)權(quán)利的立法邏輯起點(diǎn);既要充分尊重著作權(quán)的私權(quán)根本屬性,亦要充分注重權(quán)利人與傳播者、社會(huì)公眾之間的利益衡平。具體制度的構(gòu)建,既要充分考量制度設(shè)計(jì)的優(yōu)越性,亦要充分考量制度實(shí)際運(yùn)行的有效性。
[Abstract]:The third revision of our country's copyright Law is a comprehensive revision to adapt to the new situation that our society is facing. In the revision of the Law, we should base ourselves on our national conditions and legislative tradition, and focus on our country's realistic needs and long-term development. We should not only pay special attention to the legislative logic starting point of the civil law system advocating the protection of the right holders' spiritual personality rights, but also pay special attention to the legislative logic starting point of the common law system advocating the protection of the right holders' property rights. We should not only fully respect the fundamental property of copyright, but also pay attention to the balance of interests between the owner and the communicator and the public. The construction of specific system should not only consider the superiority of system design, but also the effectiveness of system operation.
