縣域金融消費(fèi)者權(quán)益保護(hù)研究

【摘要】:2007年世界金融危機(jī)爆發(fā)后,各金融監(jiān)管當(dāng)局普遍認(rèn)識到,一個高效的金融監(jiān)管體系和有效的金融消費(fèi)者保障機(jī)制須以政府立法干預(yù)和監(jiān)督管理為核心,積極謀求政府調(diào)控、自律監(jiān)管和司法救濟(jì)等各層級之間的合理分工與有機(jī)協(xié)調(diào),并能夠隨著外部環(huán)境的變動而及時做出制度調(diào)整和有效變革。 改革開放以來,我國金融宏觀調(diào)控和金融管理能力和水平得到同步提升。然而,相比西方發(fā)達(dá)國家,我國在金融消費(fèi)權(quán)益者保護(hù)方面,無論是在理論體系、法律制定還是監(jiān)管構(gòu)架等層面的研究都相對貧乏。業(yè)務(wù)運(yùn)營不合規(guī),投訴渠道不通暢,政府過度干預(yù)金融業(yè),公平服務(wù)不到位等現(xiàn)象客觀存在。在縣域,由于民眾金融知識匱乏,金融風(fēng)險意識淡薄,加上縣域金融發(fā)展遲滯,金融市場競爭不充分、監(jiān)管不到位等因素,金融消費(fèi)者權(quán)益受損的問題尤為突出。 本論文闡述了我國開展金融消費(fèi)者權(quán)益保護(hù)工作的重要意義,從監(jiān)管機(jī)構(gòu)金融消費(fèi)者保護(hù)、金融消費(fèi)者保護(hù)立法、金融機(jī)構(gòu)服務(wù)與信息披露三個方面梳理了當(dāng)前國內(nèi)外消費(fèi)者權(quán)益工作進(jìn)展和研究成果,并對金融消費(fèi)者享有的權(quán)利和金融機(jī)構(gòu)承擔(dān)的義務(wù)進(jìn)行了歸納。在介紹美國、英國、日本等發(fā)達(dá)國家的消費(fèi)者權(quán)益保護(hù)經(jīng)驗,和對我國開展金融消費(fèi)者權(quán)益保護(hù)工作進(jìn)展情況進(jìn)行簡要回顧的基礎(chǔ)上,本論文以泰州市縣域為案例,分析金融機(jī)構(gòu)金融消費(fèi)者權(quán)益保護(hù)方面存在的問題以及金融產(chǎn)品、服務(wù)的投訴分布,研究剖析造成縣域金融消費(fèi)者權(quán)益保護(hù)缺失的主要原因,從頂層設(shè)計、配套制度、金融監(jiān)管、消費(fèi)者教育等層面對縣域金融消費(fèi)者權(quán)益保護(hù)工作機(jī)制的構(gòu)建提出了設(shè)想,為金融消費(fèi)者權(quán)益保護(hù)提供借鑒和支撐。
[Abstract]:After the outbreak of the world financial crisis in 2007, the financial regulatory authorities generally recognized that an efficient financial supervision system and an effective financial consumer protection mechanism should take government legislative intervention and supervision and management as the core, and actively seek government regulation and control. The reasonable division of labor and coordination among the levels of self-discipline supervision and judicial remedy can make system adjustment and effective change in time with the change of external environment. Since the reform and opening up, the ability and level of financial macro-control and financial management have been upgraded simultaneously. However, compared with the western developed countries, the research on the protection of financial consumers' rights and interests in our country is relatively poor in terms of theoretical system, legal formulation and regulatory framework. Business operation is not regulated, complaint channels are not smooth, excessive government intervention in the financial industry, fair service is not in place and other phenomena exist objectively. In the county area, due to the lack of financial knowledge, the weak awareness of financial risk, the sluggish development of finance, the insufficient competition in financial market, the lack of supervision and other factors, the problem of financial consumer rights and interests is particularly prominent. This paper expounds the important significance of developing financial consumer rights protection in China, including financial consumer protection, financial consumer protection legislation, and financial consumer protection legislation. Three aspects of financial institutions' services and information disclosure are summarized, including the current progress and research results of consumer rights and interests at home and abroad, and the rights enjoyed by financial consumers and the obligations assumed by financial institutions. On the basis of introducing the experience of consumer rights and interests protection in developed countries such as the United States, Britain and Japan, and reviewing the progress of financial consumer rights protection in China, this paper takes the county area of Taizhou City as an example. This paper analyzes the problems existing in the protection of the rights and interests of financial consumers in financial institutions, and the distribution of complaints about financial products and services, and analyzes the main reasons for the lack of protection of the rights and interests of financial consumers in the county, from the top level to the design and supporting system. Financial supervision, consumer education and other aspects of the county financial consumer rights and interests protection mechanism for the construction of ideas for financial consumers to provide reference and support for the protection of the rights and interests of financial consumers.
