【摘要】：長時間以來,歐洲國家在農(nóng)業(yè)種植和生產(chǎn)過程中逐漸形成了良好的地方特色,尤其在農(nóng)產(chǎn)品和食品方面。如此良好的的特色生產(chǎn)機(jī)制為當(dāng)?shù)厣踔琳麄�國家的經(jīng)濟(jì)發(fā)展具有巨大的推動作用。這在很大程度上歸因于歐盟地理標(biāo)志保護(hù)制度。事實(shí)上,歐盟的地理標(biāo)志保護(hù)制度并非從一開始就是如此成熟的。在歐盟經(jīng)濟(jì)一體化之后,歐盟頒布了許多條例,旨在通過立法的方式縮小國家之間的立法差異。專門法的不斷修改和完善,極大的推動了歐盟甚至世界地理標(biāo)志保護(hù)制度的發(fā)展。我國的地理標(biāo)志保護(hù)制度雖然在本世紀(jì)發(fā)展速度較快,但是因?yàn)槠鸩捷^晚、經(jīng)驗(yàn)不足、本土適應(yīng)等問題存在很多不完善的地方。2015年是我國依法治國的開局之年,借此契機(jī),應(yīng)積極借鑒歐盟地理標(biāo)志保護(hù)制度的經(jīng)驗(yàn)完善我國對此的立法。本文首先對地理標(biāo)志的相關(guān)概念進(jìn)行釋義,包括貨源標(biāo)記、原產(chǎn)地名稱和地理標(biāo)志。之后,介紹了國際社會上對于地理標(biāo)志制度建設(shè)的努力,對《巴黎公約》、《馬德里協(xié)定》、《里斯本協(xié)定》和TRIPS協(xié)定進(jìn)行背景和內(nèi)容的介紹。隨后,文章進(jìn)入重點(diǎn)章節(jié)部分,介紹了農(nóng)產(chǎn)品和食品、葡萄酒和烈酒的重點(diǎn)條例中有關(guān)定義、背景、申請注冊等方面的內(nèi)容,并且對條例進(jìn)行綜合性的分析。隨后,闡述了我國地理標(biāo)志保護(hù)制度的發(fā)展概況、立法現(xiàn)狀和其中存在的問題。最后,提出歐盟地理標(biāo)志保護(hù)制度對我國地理標(biāo)志保護(hù)制度的借鑒及啟示。
[Abstract]:For a long time, European countries have gradually formed good local characteristics in the process of agricultural cultivation and production, especially in agricultural products and food. Such a good characteristic production mechanism for the local economy and even the entire country has a huge role in promoting economic development. This is largely due to the EU Geographical indication Protection system. In fact, the EU's geographical indications protection system was not as mature as it was from the beginning. After the economic integration of the European Union, the European Union promulgated a number of regulations aimed at reducing the legislative differences between countries by way of legislation. The constant revision and perfection of the special law has greatly promoted the development of the geographical indication protection system in the European Union and even the world. Although China's geographical indication protection system has developed rapidly in this century, due to its late start, lack of experience, and local adaptation, there are many imperfections. The year 2015 is the beginning of the country's rule of law, taking advantage of this opportunity. We should learn from the experience of EU's geographical indication protection system and perfect our country's legislation on it. In this paper, the related concepts of geographical indications, including source marks, names of origin and geographical indications are explained. After that, the paper introduces the efforts of the international community in the construction of GIS, and introduces the background and content of the Paris Convention, the Madrid Agreement, the Lisbon Agreement and the TRIPS Agreement. Then, the article goes into the key section, introduces the definition, background, application for registration of the key regulations of agricultural products and food, wine and spirits, and makes a comprehensive analysis of the regulations. Then, the development situation, legislation status and existing problems of geographical indication protection system in China are described. Finally, the paper puts forward the reference and inspiration of EU's geographical indication protection system to our country's geographical indication protection system.
