【摘要】：近年來,隨著互聯(lián)網(wǎng)行業(yè)的迅猛發(fā)展以及智能手機(jī)的廣泛應(yīng)用,手機(jī)APP也以一種爆發(fā)性的態(tài)勢快速占領(lǐng)用戶市場。在巨大的市場紅利下,APP侵權(quán)問題也悄然而生,且這種侵權(quán)行為往往就發(fā)生在知名度高、占據(jù)一定市場優(yōu)勢地位的APP上。APP侵權(quán)糾紛很多是因?qū)PP知識產(chǎn)權(quán)意識淡薄,維權(quán)力度不夠所致,因此明確APP侵犯知識產(chǎn)權(quán)的方式以及當(dāng)發(fā)生糾紛時,如何在法律上需求救濟(jì)確有必要。
[Abstract]:In recent years, with the rapid development of the Internet industry and the wide application of smart phones, mobile phone APP has also rapidly occupied the user market with an explosive situation. Under the huge market dividend, the problem of APP infringement is also quietly arising, and this kind of tort often occurs on APP, which has a high reputation and occupies a certain market advantage. Many APP infringement disputes are due to the weak awareness of APP intellectual property rights. Therefore, it is necessary to clarify the way of APP infringing intellectual property rights and how to demand relief in law when disputes arise.
