【摘要】：近年來,未成年人侵權(quán)事件頻發(fā),我國立法又凸顯出未成年人侵權(quán)方面的不足,過多考慮受害人的利益保護(hù),缺乏對未成年人侵權(quán)責(zé)任能力及歸責(zé)原則的法律評價,一味采用監(jiān)護(hù)人無過錯的替代責(zé)任,致使未成年人侵權(quán)責(zé)任的追究與受害人利益保護(hù)之間未能達(dá)到平衡。立法應(yīng)基于自由意志理論,明確未成年人可作為侵權(quán)責(zé)任的獨(dú)立承擔(dān)主體及過錯歸責(zé)原則、損害賠償來源等相關(guān)內(nèi)容。
[Abstract]:In recent years, the infringing incidents of minors occur frequently, the legislation of our country highlights the shortcomings of infringing minors, too much consideration is given to the protection of the interests of the victims, and there is a lack of legal evaluation of the ability of tort liability of minors and the principle of liability imputation. Instead of the guardian's liability without fault, there is no balance between the investigation of minor's tort liability and the protection of the victim's interests. The legislation should be based on the theory of free will, and make clear that minors can be regarded as the independent subject of tort liability, the principle of fault imputation, the source of compensation for damages and so on.
