【摘要】：本案系上海市首起因侵犯國際標準文件著作權(quán)而被公訴的刑事案件,并被國家版權(quán)局列為"2014劍網(wǎng)"行動重點案件。該案中,法院認定ISO、IEC國際標準文件屬于我國法律保護的作品,被告人王某通過網(wǎng)絡(luò)銷售盜版ISO、IEC國際標準文件的行為系《刑法》第二百一十七條所指的"復制發(fā)行"行為,并根據(jù)案件實際情況,基于刑事謙抑原則,只將從被告人處查獲的部分侵權(quán)ISO、IEC國際標準文件計入被告人侵犯著作權(quán)犯罪的數(shù)量。
[Abstract]:This case is the first criminal case in Shanghai for infringing the copyright of international standard documents and listed by the State copyright Administration as a key case of action of "2014 Sword net". In this case, the court found that the ISO,IEC international standard documents belong to the works protected by Chinese law, and the defendant Wang Mou sold pirated ISO, through the network. The behavior of the IEC international standard document is the act of "reproduction and distribution" referred to in Article 217 of the Criminal Law. According to the actual situation of the case, and based on the principle of criminal modesty, only part of the tort ISO, seized from the defendant will be seized. The IEC international standard documents account for the number of copyright infringements committed by the accused.
