【摘要】：現(xiàn)代社會,同性戀現(xiàn)象普遍存在。據(jù)社會學(xué)家分析,我國的同性戀群體數(shù)量已有幾千萬之多,但我國對此群體權(quán)利的保障尤其是立法的缺失致使其保障難以實現(xiàn)。近年來,我們常常會在新聞媒體或網(wǎng)絡(luò)上看到“同性強奸”“同性猥褻”“同妻”等字眼,這些都是由于我國同性戀權(quán)利保障的立法缺失所客觀引起的社會問題。歷史上同性戀的去罪化、去病化,以及各個學(xué)界對同性戀的研究皆已表明對同性戀權(quán)利進行保障是正當(dāng)且必要的,這同時也是我國建設(shè)和諧社會,保障人權(quán)的需要。本文從我國同性戀權(quán)利保障的立法缺失,尤其集中分析我國同性戀立法缺失即刑法和民法領(lǐng)域的空白及由此所引發(fā)的若干問題入手,進而分析論證了我國同性戀權(quán)利保障的可行性與必要性,在借鑒國外國家立法經(jīng)驗的基礎(chǔ)上,提出我國構(gòu)建同性戀權(quán)利保障的立法建議,以便更好的保護我國同性戀者的各項合法權(quán)益。
[Abstract]:In modern society, homosexuality is widespread. According to the analysis of sociologists, there are tens of millions of gay groups in our country, but the protection of the rights of this group, especially the lack of legislation, makes it difficult to realize. In recent years, we often see the words "same-sex rape", "same-sex molestation" and "same-wife" in the news media or on the Internet. These are the social problems caused by the lack of legislation on the protection of gay rights in China. In history, the decriminalization of homosexuality and the study of homosexuality in various academic circles have shown that the protection of gay rights is justified and necessary, which is also the need to build a harmonious society and protect human rights in our country. This article begins with the lack of legislation on the protection of gay rights in our country, especially analyzes the gaps in the field of criminal law and civil law and some problems arising therefrom. Then it analyzes and demonstrates the feasibility and necessity of the protection of gay rights in our country. On the basis of drawing lessons from the legislative experience of foreign countries, it puts forward some legislative suggestions for constructing the protection of gay rights in our country. In order to better protect the legitimate rights and interests of homosexuals in China.
