【摘要】：傳統(tǒng)民法權利體系雖對環(huán)境權進行了部分吸納,但二者卻并不完全兼容,實質上更多地對環(huán)境權表現(xiàn)出排斥的情況,故將環(huán)境權在民法典中進行明確顯得尤為必要。正確厘清民法上環(huán)境權是解決環(huán)境權融入民法典的關鍵,鑒于請求權在民法權利體系中居于樞紐的地位,應緊密結合環(huán)境權中的私法要素,以環(huán)境權作為民法上請求權的基礎權利,對環(huán)境權請求權體系,即在民法典中明確環(huán)境權的內容、環(huán)境權作為基礎權利的請求權內容、侵權損害賠償請求權以及恢復原狀、環(huán)境修復請求權等方面進行合理構建,力求讓環(huán)境權合乎邏輯、恰如其分地融入到民法典中。
[Abstract]:Although the traditional civil law rights system has partially absorbed the environmental rights, they are not completely compatible. In essence, they are more exclusive to the environmental rights, so it is particularly necessary to make the environmental rights clear in the civil code. To correctly clarify the environmental rights in civil law is the key to solve the integration of environmental rights into the civil code. In view of the pivotal position of the right to claim in the civil law system, it is necessary to closely combine the elements of private law in environmental rights. Taking the environmental right as the basic right of claim in the civil law, the system of claiming the environmental right is defined in the civil code as the content of the environmental right, the environmental right as the claim content of the basic right, the claim right of tort damage compensation and the restitution of the original state. In order to make the environmental right logical and appropriately integrated into the civil code, the right of environmental repair is constructed reasonably.
