【摘要】：作品的增值利益作為著作權(quán)法中可分配利益的一種,產(chǎn)生于作品的利用階段,源于主體對要素的投入。由于不同種類作品對各要素需求程度不同,不同原因產(chǎn)生的增值利益中要素的貢獻(xiàn)各異,因此在分配作品增值利益之前,需要對利益的構(gòu)成要素進(jìn)行細(xì)分。同時,以利益為保護(hù)起點的著作權(quán)法,理應(yīng)堅持追求分配正義的法律目的。在此目標(biāo)指引下構(gòu)建整體性的著作權(quán)法利益分配機制,并按照要素的貢獻(xiàn)對作品增值利益進(jìn)行分配。
[Abstract]:As a kind of distributable interest in copyright law, the value-added interest of works comes from the stage of the use of the works and originates from the input of the main body to the elements. Because different kinds of works have different demand for each element and the contribution of the elements in the value added interest is different for different reasons, it is necessary to subdivide the constituent elements of the interest before distributing the value-added interest of the work. At the same time, the copyright law, which takes interest as the starting point of protection, should insist on pursuing the legal purpose of distributive justice. Under the guidance of this goal, the author constructs the whole mechanism of interest distribution of copyright law, and distributes the value-added benefits of works according to the contribution of the elements.
