【摘要】：“非法人組織”是從既有民事立法中的“其他組織”發(fā)展而來(lái)。“其他組織”在我國(guó)立法中有非主體意義和主體意義兩種用法。非主體意義的“其他組織”不是規(guī)范、科學(xué)的法律概念,主體意義的“其他組織”用于統(tǒng)一指稱自然人、法人之外的第三類民事主體�！胺欠ㄈ私M織”與民事主體意義的“其他組織”內(nèi)涵相同、外延重疊,在邏輯上屬于同一關(guān)系。在民事領(lǐng)域,“非法人組織”系對(duì)各民事單行法中“其他組織”的默示修改,應(yīng)基于后法優(yōu)于前法的原理予以適用;但在經(jīng)濟(jì)法、行政法等其他領(lǐng)域,《民法總則》的修改不具有規(guī)范效力,在依法定權(quán)限和程序完成立法語(yǔ)言修改前,這些領(lǐng)域中的“其他組織”將長(zhǎng)期存在�；诖�,有必要由全國(guó)人大常委會(huì)對(duì)“非法人組織”和“其他組織”的含義和適用作出立法解釋。
[Abstract]:The non-legal person organization is developed from other organizations in the existing civil legislation. There are two uses of "other organizations" in the legislation of our country. The "other organization" in the non-subjective sense is not the norm, the scientific legal concept, and the "other organization" in the subjective meaning is used to unify the reference to the third kind of civil subject other than the natural person and the legal person. The meaning of "non-legal person organization" and "other organization" in the meaning of civil subject is the same, and its extension overlaps, so it belongs to the same relationship logically. In the field of civil affairs, "unincorporated organization" is an implied modification of "other organizations" in individual civil laws, which should be applied on the basis of the principle that the latter law is superior to the former law. However, in other fields such as economic law, administrative law and other fields, the revision of General principles of Civil Law does not have normative effect. "other organizations" in these fields will exist for a long time before the legislative language revision is completed according to the legal authority and procedure. Therefore, it is necessary for the standing Committee of the National people's Congress to legislate on the meaning and application of "unincorporated organization" and "other organization".
