【摘要】：我國《民法總則》突出了對個人人格尊嚴和人格權的保護,也提出了制定我國民法典人格權編的現(xiàn)實要求。人格權編的規(guī)則設計應當以我國《民法總則》和《民法通則》為基礎,積極總結我國人格權保護的立法經驗。同時,人格權編的規(guī)則設計應當以我國司法實踐為基礎,力求解決我國的現(xiàn)實問題,并體現(xiàn)人文關懷的時代精神、反映網絡和大數(shù)據時代的時代特征。在具體內容安排方面,人格權編應當包括人格權的一般規(guī)定、具體人格權、人格權益的許可使用與限制以及侵害人格權的責任等內容。
[Abstract]:The General principles of Civil Law of our country highlight the protection of personal dignity and personality right, and also put forward the practical requirements of making up the personal right of civil code in our country. The design of the rules of personality right compilation should be based on the general principles of civil law and general principles of civil law in our country and sum up the legislative experience of personality right protection in our country. At the same time, the design of the rules of personality right should be based on the judicial practice of our country, try to solve the realistic problems of our country, embody the spirit of humanistic care, and reflect the characteristics of the times in the era of network and big data. In the aspect of content arrangement, personality rights should include the general provisions of personality rights, the specific personality rights, the permission and limitation of personality rights and interests, and the responsibility of infringing personality rights.
