【摘要】：由于存在有中國(guó)特色的立法官僚化,當(dāng)前民法典編纂的進(jìn)度對(duì)編纂進(jìn)程和未來(lái)民法典的內(nèi)容與形式均會(huì)產(chǎn)生重大影響。此次的民法典很難成為世界上偉大的法典。期待民法典發(fā)揮憲法性功能,以民法典實(shí)現(xiàn)限制公權(quán)、促進(jìn)社會(huì)轉(zhuǎn)型也不現(xiàn)實(shí)。當(dāng)今社會(huì)民法法典化的功能只能被定位于體系整合。學(xué)界應(yīng)對(duì)本次民法典編纂抱有平常心,重點(diǎn)在法典的體系整合功能上著力。
[Abstract]:Due to the existence of the legislation bureaucracy with Chinese characteristics, the current progress of the compilation of the civil code will have a significant impact on the compilation process and the content and form of the future civil code. This time the Civil Code is hardly a great code in the world. It is not realistic to expect civil code to exert constitutional function, to restrict public power and to promote social transformation. The function of the codification of civil law in today's society can only be positioned in the integration of the system. The academic circles should have a common mind on the codification of the civil code, focusing on the system integration function of the code.
