【摘要】：我國立體車庫的財產(chǎn)權(quán)性質(zhì)游離于建筑物、構(gòu)筑物與設(shè)備之間,絕大多數(shù)未進行不動產(chǎn)登記,導(dǎo)致開發(fā)企業(yè)、管理者、業(yè)主、消費者多方主體困惑。鑒于立體車庫固定于所占地塊,利用圍合空間,可測算建筑面積,物理界線封閉,宜將其認定為建筑物。參照現(xiàn)行規(guī)范,我國立體車庫產(chǎn)權(quán)登記的主要路徑包括:明確立體車庫的土地使用權(quán),編制立體車庫工程規(guī)劃,對立體車庫工程進行竣工驗收,測繪立體車庫及其停車位,登記立體車庫停車位所有權(quán)。
[Abstract]:The property right of the three-dimensional garage in our country is free between the buildings, the structure and the equipment, and most of them do not register the real estate, which leads to the confusion of the development enterprise, the manager, the owner and the consumer. In view of the solid garage fixed in the occupied land, using the enclosed space, the building area can be calculated and the physical boundary is closed, it should be recognized as a building. Referring to the current regulations, the main ways to register the property rights of the stereoscopic garages in China include: defining the land use right of the stereoscopic garages, drawing up the plans for the construction of the stereoscopic garages, checking and accepting the completion of the projects, surveying and mapping the stereoscopic garages and their parking spaces, Register the ownership of three-dimensional garage parking spaces.
