【摘要】：隨著網(wǎng)絡(luò)的普及,本來小范圍傳播的同人小說越來越受歡迎,但由于其屬于對(duì)原有作品的二次創(chuàng)作,容易引起著作權(quán)侵權(quán)糾紛,而中國目前的法律又沒有明確規(guī)定這種類型的作品是否合法,造成了同人小說著作權(quán)問題沒有統(tǒng)一的標(biāo)準(zhǔn)。文章通過介紹同人小說的基本情況,分析其中存在著作權(quán)問題,提出了應(yīng)對(duì)同人小說著作權(quán)的一些建議。
[Abstract]:With the popularity of the network, the original small spread of human fiction is becoming more and more popular, but because it belongs to the second creation of the original works, it is easy to cause copyright infringement disputes. However, the current law of China does not specify whether this type of work is legal or not, which leads to the lack of a unified standard of copyright in the same person's novel. By introducing the basic situation of the same person novel, this paper analyzes the problem of copyright and puts forward some suggestions to deal with the copyright of the same person novel.
