【摘要】：中國自古以來就是禮儀之邦,情誼行為在中國這個人情社會里表現(xiàn)形態(tài)繁雜多樣。情誼行為這個法律概念最早源于德國的判例學說,我國有關情誼行為致人損害的案件在民事司法實務中也比較豐富,對該問題的理論研究是比較必要的。筆者首先結(jié)合民法基本理論,在已有的研究成果之上進行了知識的總結(jié)與進一步思考,在歸納了不同學者對于情誼行為所下的定義與分類的基礎上,分析了情誼行為的成立要件并對其進行了定義概括。其次,筆者分析了情誼行為的性質(zhì)以及情誼行為性質(zhì)的轉(zhuǎn)換——情誼行為致人損害的請求權(quán)基礎。最后筆者重點分析了情誼行為致人損害的侵權(quán)責任,包括構(gòu)成要件、規(guī)則原則以及使用減輕和免除的規(guī)則,希望能為司法實踐工作提供一些參考。
[Abstract]:Since ancient times, China has been a state of ceremony, and the behavior of friendship in the human society of China is diverse and diverse. The legal concept of friendship act originated from the jurisprudence of Germany, and the case of the damage caused by friendship act in our country is abundant in the civil judicial practice, so it is necessary to study the theory of this problem. First of all, the author combined the basic theory of civil law, on the basis of the existing research results, the author summarized the knowledge and further thought, on the basis of the different scholars' definition and classification of friendship behavior, This paper analyzes the essential elements of the establishment of friendship behavior and defines and generalizes it. Secondly, the author analyzes the nature of the friendship act and the transformation of the friendship behavior nature the basis of the right of claim for the damage caused by the friendship act. Finally, the author focuses on the analysis of the tort liability for the damage caused by the friendship act, including the constitutive elements, the principles of the rules and the rules of mitigation and exemption, hoping to provide some references for the judicial practice.
