【摘要】：綜藝節(jié)目侵權(quán)的話題近年來持續(xù)升溫,但業(yè)界對(duì)其侵權(quán)的態(tài)度卻莫衷一是。筆者認(rèn)為,對(duì)待綜藝節(jié)目的保護(hù)可以嘗試從綜藝節(jié)目影像與綜藝節(jié)目版式兩個(gè)維度進(jìn)行討論。對(duì)綜藝節(jié)目影像而言,可以類比文學(xué)藝術(shù)作品中關(guān)于剽竊的認(rèn)定,堅(jiān)持"先部分、后整體、看比例、問大眾"的原則。對(duì)待節(jié)目版式,可以嘗試認(rèn)定獨(dú)創(chuàng)性高的版式為匯編作品,而對(duì)獨(dú)創(chuàng)性相對(duì)低一些的可以嘗試增設(shè)一項(xiàng)專門保護(hù)節(jié)目版式制作者的鄰接權(quán)來保護(hù)其權(quán)利。
[Abstract]:Variety show tort topics in recent years continue to heat up, but the industry on its infringement attitude is not unanimous. The author thinks that the protection of variety show can be discussed from two dimensions of variety show image and variety program layout. To the variety show video, we can compare the recognition of plagiarism in literary and artistic works, adhere to the principle of "first part, then whole, see proportion, ask the public" principle. For the program layout, we can try to identify the original layout as the compilation works, while for the relatively low originality, we can try to add a special protection program layout producer's neighboring right to protect its rights.
