網(wǎng)絡(luò)購物合同標(biāo)的物的風(fēng)險(xiǎn)負(fù)擔(dān)問題探析

【摘要】:隨著計(jì)算機(jī)及互聯(lián)網(wǎng)技術(shù)的快速發(fā)展,網(wǎng)絡(luò)購物逐漸成為人們的重要消費(fèi)模式之一。但網(wǎng)絡(luò)購物合同相較于傳統(tǒng)買賣合同的特殊性,使其標(biāo)的物風(fēng)險(xiǎn)轉(zhuǎn)移的認(rèn)定更加復(fù)雜。交易的標(biāo)的物為無形電子信息產(chǎn)品時(shí),以買受人收到電子信息產(chǎn)品或者權(quán)利憑證作為風(fēng)險(xiǎn)轉(zhuǎn)移的時(shí)點(diǎn);交易的標(biāo)的物為有形物時(shí),不論是賣方包郵還是買方自付運(yùn)費(fèi),承運(yùn)人貨交買方時(shí)標(biāo)的物風(fēng)險(xiǎn)才隨之轉(zhuǎn)移。
[Abstract]:With the rapid development of computer and Internet technology, online shopping has gradually become one of the important consumption patterns. But the particularity of the online shopping contract compared with the traditional sale contract makes the identification of the subject matter risk transfer more complicated. When the subject matter of the transaction is an intangible electronic information product, the buyer shall receive the electronic information product or the certificate of entitlement as the point of risk transfer; when the subject matter of the transaction is tangible, whether by package mail from the seller or by the buyer's own freight, The risk of the subject matter is transferred only when the goods are delivered to the buyer.
