【摘要】：演繹作品的作者身份確認(rèn),涉及演繹作品的創(chuàng)作意圖、創(chuàng)作貢獻(xiàn)、原創(chuàng)性三個(gè)要件的判斷。就演繹作品的創(chuàng)作意圖而言,作者要在已有作品或者素材基礎(chǔ)之上,體現(xiàn)自身人格及主觀內(nèi)容的意圖,同時(shí)不同于合作作品意圖;就演繹作品的創(chuàng)作貢獻(xiàn)而言,涉及到與思想表達(dá)二分法、實(shí)質(zhì)性相似、合理使用三者的關(guān)系;就演繹作品的原創(chuàng)性要件而言,分為可區(qū)別性改變標(biāo)準(zhǔn)與實(shí)質(zhì)性改變標(biāo)準(zhǔn),兩者關(guān)注的只是視角不同,沒有本質(zhì)性差別。適用兩個(gè)標(biāo)準(zhǔn)時(shí)又涉及功能性因素、新介質(zhì)轉(zhuǎn)化、高度藝術(shù)技巧和復(fù)雜勞動三個(gè)因素的考慮。
[Abstract]:The identification of the author of the deductive work involves the judgment of the creative intention, contribution and originality of the deductive work. As far as the creative intention of the deductive work is concerned, the author should embody his own personality and intention of subjective content on the basis of the existing works or materials, and be different from the intention of the cooperative work at the same time; in terms of the creative contribution of the deductive work, It involves the relationship with the dichotomy of thought expression, substantive similarity and rational use of the three aspects. In terms of the originality elements of the deductive works, they are divided into differentiable and substantive change standards, which focus only on different perspectives. There is no essential difference. The application of the two standards involves functional factors, new medium transformation, high artistic skills and complex labor considerations.
