【摘要】：專利惡意訴訟案件近年來不斷增多,而我國關(guān)于專利惡意訴訟的研究較少,本文首先從概念上對專利惡意訴訟進(jìn)行厘清。其次從專利惡意訴訟的現(xiàn)狀和法律規(guī)定的缺乏兩個(gè)角度對規(guī)制的必要性展開分析。進(jìn)而從主觀故意和行為缺乏合法性兩個(gè)方面對認(rèn)定標(biāo)準(zhǔn)進(jìn)行鑒別,最后則從完善不侵權(quán)確認(rèn)之訴制度、明確反賠責(zé)任制度,建立懲罰性賠償制度和嚴(yán)格審查起訴行為四個(gè)方面提出改進(jìn)專利惡意訴訟法律規(guī)制的建議。
[Abstract]:Patent malicious litigation cases have been increasing in recent years, but there are few researches on patent malicious litigation in China. Firstly, this paper clarifies the concept of patent malicious litigation. Secondly, the necessity of regulation is analyzed from the current situation of patent malicious litigation and the lack of legal provisions. Then from the subjective intent and the lack of legitimacy of the conduct of the two aspects of the identification of the criteria to identify the criteria, and finally from the perfection of non-tort confirmation of the system of litigation, clear system of liability for counterclaims, Four aspects of punitive damages system and strict review of prosecution are proposed to improve the legal regulation of patent malicious litigation.
