金融消費者權(quán)益保護下商業(yè)銀行社會責(zé)任研究

【摘要】:20世紀(jì)80年代,西方逐漸興起“企業(yè)社會責(zé)任運動”,并在90年代得到多方關(guān)注和支持而獲得蓬勃發(fā)展,其理念也得到進一步傳播。商業(yè)銀行作為特殊的企業(yè),更是積極參與其中。與國際商業(yè)銀行相比,我國商業(yè)銀行在履行社會責(zé)任方面還處在較為落后的狀態(tài),尤其在商業(yè)銀行對金融消費者履行社會責(zé)任方面,金融消費者權(quán)益屢受侵害。本文在此背景下,以商業(yè)銀行社會責(zé)任為研究內(nèi)容,從金融消費者權(quán)益保護的角度,探究在我國,商業(yè)銀行應(yīng)如何履行其社會責(zé)任,保護金融消費者權(quán)益。文章正文主要包括以下幾部分: 第一部分為引言。在闡述本文的選題背景和研究意義的基礎(chǔ)上,對商業(yè)銀行社會責(zé)任、金融消費者權(quán)益保護等內(nèi)容的國內(nèi)外研究現(xiàn)狀進行分析整理,并簡要介紹了本文的創(chuàng)新之處。 第二部分為金融消費者權(quán)益與商業(yè)銀行社會責(zé)任的概述。本部分分別對金融消費者權(quán)益與商業(yè)銀行社會責(zé)任相關(guān)理論進行闡述,并就金融消費者權(quán)益保護下商業(yè)銀行社會責(zé)任的主要內(nèi)容進行分析。 第三部分對金融消費者權(quán)益保護下商業(yè)銀行社會責(zé)任存在的問題進行分析。主要闡述了商業(yè)銀行履行金融消費者社會責(zé)任的現(xiàn)狀及法律規(guī)制,,并就商業(yè)銀行履行金融消費者社會責(zé)任存在問題的原因進行分析。 第四部分為國外商業(yè)銀行履行金融消費者社會責(zé)任的法律規(guī)制及啟示。主要通過介紹美國、英國關(guān)于商業(yè)銀行在履行金融消費者社會責(zé)任方面的立法及規(guī)制,總結(jié)其經(jīng)驗,以為完善我國商業(yè)銀行履行金融消費者社會責(zé)任提供法律借鑒。 第五部分為我國商業(yè)銀行履行金融消費者社會責(zé)任法律規(guī)制的完善。文章主要從完善立法、加強商業(yè)銀行內(nèi)部治理及強化政府、行業(yè)組織、第三方力量等外部監(jiān)督三個部分為我國商業(yè)銀行履行社會責(zé)任提供完善建議。
[Abstract]:In the eighties of the 20th century, the "corporate social responsibility movement" gradually rose in the West, and developed vigorously in the 1990s because of the attention and support of many parties, and its concept was further spread. Commercial banks as special enterprises, but also actively participate in them. Compared with the international commercial banks, the commercial banks of our country are still in a relatively backward state in performing their social responsibility, especially when the commercial banks fulfill their social responsibility to the financial consumers, the rights and interests of the financial consumers are often infringed upon. Under this background, taking the social responsibility of commercial banks as the research content, from the angle of protecting the rights and interests of financial consumers, this paper explores how commercial banks should fulfill their social responsibility and protect the rights and interests of financial consumers in our country. The main body of the article includes the following parts: the first part is the introduction. On the basis of expounding the background and significance of this paper, this paper analyzes and arranges the domestic and international research status of commercial bank social responsibility, financial consumer rights and interests protection, and briefly introduces the innovation of this paper. The second part is an overview of financial consumers' rights and interests and the social responsibility of commercial banks. In this part, the relevant theories of financial consumers' rights and interests and commercial banks' social responsibility are expounded, and the main contents of commercial banks' social responsibility under the protection of financial consumers' rights and interests are analyzed. The third part analyzes the problems existing in the social responsibility of commercial banks under the protection of the rights and interests of financial consumers. This paper mainly expounds the present situation and legal regulation of commercial banks' fulfilling financial consumers' social responsibility, and analyzes the reasons for the problems existing in commercial banks' fulfilling financial consumers' social responsibility. The fourth part is the legal regulation and enlightenment of foreign commercial banks to fulfill the social responsibility of financial consumers. By introducing the legislation and regulation of commercial banks in fulfilling the social responsibility of financial consumers in the United States and Britain, this paper summarizes their experiences and provides legal reference for perfecting the performance of social responsibility of financial consumers by commercial banks in our country. The fifth part is the perfection of our country's commercial banks to fulfill the social responsibility of financial consumers. This article mainly from consummates the legislation, strengthens the commercial bank internal governance and strengthens the government, the profession organization, the third party strength and so on external supervision three parts provides the consummation suggestion for our country commercial bank to fulfill the social responsibility.
