【摘要】：囿于我國(guó)現(xiàn)行繼承法對(duì)基本原則表述的文本性缺失,學(xué)界對(duì)繼承法基本原則的存在形式、內(nèi)容取舍與條文表述等產(chǎn)生了巨大爭(zhēng)議。在法典化態(tài)勢(shì)下,繼承編基本原則的建構(gòu)事關(guān)法典形式理性、繼承本體存在之證成與政治國(guó)家之預(yù)防。繼承編基本原則的建構(gòu)應(yīng)以繼承權(quán)本體為實(shí)質(zhì)取舍標(biāo)準(zhǔn),以"線性"邏輯進(jìn)路為技術(shù)支撐,并輔之以繼承法律制度的臨界點(diǎn)為制度基準(zhǔn),以此在繼承線性法律關(guān)系的動(dòng)態(tài)化模型下形成"保護(hù)私有財(cái)產(chǎn)繼承權(quán)"和"養(yǎng)老育幼"的二原則體系并貫穿于整個(gè)繼承法律制度,從而在橋接民法基本原則之時(shí)形成私法體系內(nèi)部的板塊區(qū)分效應(yīng)。
[Abstract]:Due to the lack of textual representation of the basic principles in China's current inheritance law, there are great controversies in academic circles on the existence of basic principles of inheritance law, the choice of contents and the expression of articles. Under the situation of codification, the construction of the basic principle of succession compilation is related to the formal rationality of the code, the proof of the existence of inheritance ontology and the prevention of political state. The construction of the basic principle of succession compilation should be based on the Noumenon of inheritance as the essential criterion, the "linear" logic approach as the technical support, and the critical point of the succession legal system as the system benchmark. In this way, under the dynamic model of inheritance linear legal relationship, the two principle systems of "protecting private property inheritance rights" and "providing for the aged and raising children" are formed and run through the whole inheritance legal system. Thus, when bridging the basic principles of civil law, it forms the plate differentiation effect within the private law system.
