【摘要】：信息網(wǎng)絡(luò)傳播行為是信息網(wǎng)絡(luò)傳播權(quán)的基本問(wèn)題,爭(zhēng)議不止,判斷標(biāo)準(zhǔn)不一,仍有進(jìn)一步研究之必要。以傳播機(jī)制為背景考察信息網(wǎng)絡(luò)傳播,以體系解釋方法和法律規(guī)范的目的解讀信息網(wǎng)絡(luò)傳播行為,作品提供和服務(wù)提供本質(zhì)都是向公眾傳播。行為的界定是認(rèn)定侵權(quán)責(zé)任的起點(diǎn),侵權(quán)法原則和規(guī)范制約著行為定性,深層盜鏈?zhǔn)欠袂址感畔⒕W(wǎng)絡(luò)傳播權(quán),應(yīng)在視其為信息網(wǎng)絡(luò)傳播行為的前提下,運(yùn)用侵權(quán)法法律標(biāo)準(zhǔn)作出認(rèn)定。
[Abstract]:The behavior of information network communication is the basic problem of information network communication right. With the background of communication mechanism, this paper investigates information network communication, interprets the behavior of information network communication with the purpose of system interpretation method and legal norm. The essence of providing works and providing services is to communicate to the public. The definition of the act is the starting point of confirming the tort liability, the principles and norms of the tort law restrict the characterization of the act, and whether the deep chain theft infringes the right of information network communication should be regarded as the information network communication behavior. Use the tort law legal standard to make the determination.
