【摘要】：養(yǎng)老涉及到每個(gè)人晚年生活的品質(zhì),因此而備受大家關(guān)注。由于計(jì)劃生育政策改變了原有的家庭結(jié)構(gòu)再加上工業(yè)化浪潮的影響,家庭養(yǎng)老功能逐漸弱化,機(jī)構(gòu)養(yǎng)老由于高昂的收費(fèi)也使得許多老人望而卻步,此時(shí),社區(qū)養(yǎng)老以其成本低,服務(wù)內(nèi)容豐富,利用率高,功能全等成為一種新興的熱門養(yǎng)老服務(wù)。本文立足于我國未富先老的時(shí)代大背景下,始終以更好地實(shí)現(xiàn)老人的養(yǎng)老權(quán)為宗旨。為了更好地把握社區(qū)養(yǎng)老的本質(zhì)內(nèi)涵首先闡述了社區(qū)養(yǎng)老的基本理論,其次從我國社區(qū)養(yǎng)老的現(xiàn)行法律規(guī)范著手,找出其中存在的問題,最后通過國外相關(guān)內(nèi)容的研究對(duì)我國社區(qū)養(yǎng)老法律規(guī)范提出幾點(diǎn)完善建議。全文共分為四部分:第一部分社區(qū)養(yǎng)老的基本理論和發(fā)展現(xiàn)狀。主要包括社區(qū)養(yǎng)老的理論基礎(chǔ)、理論淵源和發(fā)展現(xiàn)狀三方面內(nèi)容。理論基礎(chǔ)主要闡述了社區(qū)養(yǎng)老的含義、特征和權(quán)利基礎(chǔ);社區(qū)養(yǎng)老的理論淵源是從社會(huì)嵌入理論、社會(huì)福利多元主義和需求層次理論進(jìn)行陳述。上述內(nèi)容共同構(gòu)成了社區(qū)養(yǎng)老的理論支撐。社區(qū)養(yǎng)老的發(fā)展現(xiàn)狀分析了在發(fā)展過程中存在的問題及成因分析。第二部分著重從成因中相關(guān)法律規(guī)范的角度考察,分析了社區(qū)養(yǎng)老機(jī)構(gòu)的市場準(zhǔn)入、退出機(jī)制,社區(qū)養(yǎng)老服務(wù)標(biāo)準(zhǔn),社區(qū)養(yǎng)老合同,社區(qū)養(yǎng)老的監(jiān)管等方面存在的問題。第三部分國外社區(qū)養(yǎng)老法律規(guī)制研究。通過對(duì)英美法系中英國、美國、澳大利亞社區(qū)養(yǎng)老的相關(guān)法律規(guī)范和大陸法系中德國和日本社區(qū)養(yǎng)老的法律規(guī)范進(jìn)行研究,并獲得相應(yīng)的啟示。第四部分社區(qū)養(yǎng)老法律規(guī)范的完善建議。對(duì)上述我國社區(qū)養(yǎng)老法律規(guī)范存在的問題,結(jié)合國外的經(jīng)驗(yàn)啟示,逐一提出符合我國基本國情的完善建議。
[Abstract]:Old-age care involves the quality of each person's life in old age, so it has attracted much attention. Because the family planning policy has changed the original family structure and the influence of the industrialization tide, the family pension function has been weakened gradually, the institution old-age care has also made many old people put off because of the high charge. At this time, the community old-age care is low in cost. The service content is rich, the utilization rate is high, the function all becomes one kind of new popular pension service. This paper is based on the background of the old age before we get rich, and always aims at realizing the right of the aged better. In order to better grasp the essential connotation of community old-age care, this paper first expounds the basic theory of community old-age support, and then starts with the current legal norms of community old-age support in China, and finds out the existing problems. Finally, through the study of the relevant contents of foreign countries, some suggestions are put forward to improve the legal norms of community pension in our country. The paper is divided into four parts: the first part is the basic theory and development of community pension. Mainly includes the community endowment theory foundation, the theory origin and the development present situation three aspects content. The theoretical basis mainly expounds the meaning, characteristics and right basis of community old-age support, and the theoretical origin of community old-age support is stated from the theory of social embedding, social welfare pluralism and the theory of hierarchy of needs. The above contents together constitute the theoretical support of community pension. This paper analyzes the problems and causes of the development of community pension. The second part focuses on the causes of the relevant legal norms from the perspective of the analysis of community pension institutions market access, withdrawal mechanism, community pension service standards, community pension contracts, community pension supervision and other aspects of the problems. The third part studies the legal regulation of community pension in foreign countries. This paper studies the relevant legal norms of community pension in Anglo-American law system, the United States and Australia, and the legal norms of community pension in Germany and Japan in the continental law system, and obtains the corresponding enlightenment. The fourth part is the suggestion of perfecting the legal norm of community pension. On the basis of the above problems in the legal norms of community pension in our country and the enlightenment of foreign experiences, the author puts forward some suggestions to perfect them one by one in accordance with the basic national conditions of our country.
