論農(nóng)民住房有限抵押

【摘要】:農(nóng)民住房抵押以有限抵押為基本理念,但現(xiàn)有制度設(shè)計存在"房地一體"與"房地分離"的路徑分歧和配套制度缺失或法理悖論等問題。這些問題的產(chǎn)生與有限抵押的設(shè)計理據(jù)存在偏差不無關(guān)系。因此,在重述農(nóng)民住房有限抵押的正當(dāng)理據(jù)不是宅基地使用權(quán)的身份性、無償性或福利性,而應(yīng)是保證農(nóng)戶基本住房權(quán)利、兼顧集體與農(nóng)戶對宅基地使用權(quán)增值收益分享的基礎(chǔ)上,本文對試點地區(qū)與非試點地區(qū)農(nóng)民住房有限抵押進(jìn)行類型化制度重構(gòu)。在試點地區(qū),宜堅持"房地一體"抵押、合理取舍地方實踐之有限抵押的設(shè)計,并完善宅基地使用權(quán)的主體限定、增值收益分配以及非本集體成員受讓地權(quán)的登記、期限限制等配套制度;在非試點地區(qū),暫時可按"房地分離"的思路,創(chuàng)新法定租賃權(quán),但應(yīng)從租金歸屬、擔(dān)?腕w、出租人等方面對相關(guān)建議進(jìn)行改造。
[Abstract]:Farmers' housing mortgage is based on the concept of limited mortgage, but there are some problems in the design of the present system, such as "integration of premises" and "separation of premises", lack of supporting system or paradox of legal theory, etc. These problems have something to do with the design motivation of finite mortgage. Therefore, the legitimate justification for restating the limited mortgage of farmers' housing is not the identity, gratuitous or welfare nature of the right to use the homestead, but the guarantee of the farmers' basic housing rights. Based on the sharing of value-added income between the collective and the farmers on the right to use the homestead, this paper reconstructs the typological system of the limited mortgage of the farmers' housing in the pilot area and the non-pilot area. In the pilot area, we should adhere to the "premises as a whole" mortgage, reasonably choose and choose the design of the limited mortgage of local practice, and perfect the subject limit of the right to use the homestead, the distribution of value-added income and the registration of the land rights assigned to the non-members of the collective. In the non-pilot area, we can innovate the legal lease right according to the idea of "separation of premises", but we should reform the relevant suggestions from the aspects of rent ownership, guarantee object, lessor and so on.
