【摘要】：互聯(lián)網(wǎng)數(shù)字技術(shù)在電視電影產(chǎn)業(yè)領(lǐng)域的應(yīng)用,使得數(shù)字化后的影視作品在傳播距離上不再受制于物理?xiàng)l件,通過有線或者無線技術(shù)大幅增加了傳播范圍,這歸功于時(shí)下互聯(lián)網(wǎng)與傳統(tǒng)產(chǎn)業(yè)結(jié)合發(fā)展的模式。同時(shí),也使得網(wǎng)絡(luò)終端用戶不再受制于場地、時(shí)間等因素,幾乎可以隨時(shí)隨地、隨心所欲地觀賞網(wǎng)絡(luò)上的優(yōu)秀影視作品。數(shù)字環(huán)境下的著作權(quán)關(guān)系中一個(gè)非常重要的環(huán)節(jié)就是網(wǎng)絡(luò)內(nèi)容服務(wù)提供商,通俗的講就是視頻分享網(wǎng)站,由于其所提供的內(nèi)容一般具有原創(chuàng)性、互動(dòng)性、便捷性等特點(diǎn),使得這種互聯(lián)網(wǎng)與傳統(tǒng)產(chǎn)業(yè)相結(jié)合的模式迅速成為全球文化產(chǎn)業(yè)發(fā)展的焦點(diǎn)。與此同時(shí),我國在此領(lǐng)域也在進(jìn)行著自我的變革,涌現(xiàn)出了諸如優(yōu)酷網(wǎng)、搜狐視頻等一批優(yōu)秀的互聯(lián)網(wǎng)影視平臺(tái)產(chǎn)業(yè)公司。新生事物的產(chǎn)生與發(fā)展或多或少都伴隨著一些問題,互聯(lián)網(wǎng)數(shù)字技術(shù)的應(yīng)用為社會(huì)公眾的日常文化生活提供極大便利的同時(shí),由于產(chǎn)業(yè)中巨大的利益驅(qū)使,某些網(wǎng)絡(luò)內(nèi)容服務(wù)提供商不惜以侵犯影視作品權(quán)益來求得發(fā)展。要解決這些問題,就要找出著作權(quán)人、網(wǎng)絡(luò)終端用戶、網(wǎng)絡(luò)內(nèi)容服務(wù)提供商之間的平衡點(diǎn),在充分保障網(wǎng)絡(luò)環(huán)境下影視作品著作權(quán)人利益的同時(shí),又能滿足網(wǎng)絡(luò)終端用戶從網(wǎng)絡(luò)內(nèi)容服務(wù)提供者處合法、合理的欣賞到優(yōu)秀的文藝影視作品,還能促進(jìn)網(wǎng)絡(luò)內(nèi)容服務(wù)提供商的持續(xù)、健康發(fā)展。這個(gè)問題已經(jīng)成為當(dāng)下各國著作權(quán)制度研究的熱點(diǎn)問題。
[Abstract]:The application of Internet digital technology in the field of television and film industry makes the digitized film and television works no longer subject to physical conditions in the distance of transmission, and greatly increases the range of transmission through cable or wireless technology. This is due to the current Internet and traditional industry development model. At the same time, it also makes the network end users no longer subject to the site, time and other factors, almost anytime, anywhere, wherever you like to watch the excellent film and television works on the network. A very important link in the copyright relationship under the digital environment is the network content service provider, which is generally called the video sharing website, because the content it provides is generally original, interactive, convenient and so on. The combination of the Internet and traditional industries has rapidly become the focus of global cultural industry development. At the same time, our country is also carrying on the self-transformation in this field, such as Youku, Sohu video and other excellent Internet film and television platform industry companies. The emergence and development of new things are more or less accompanied by some problems. The application of Internet digital technology provides great convenience for the daily cultural life of the public, at the same time, because of the huge interests in the industry, Some network content service providers do not hesitate to violate the rights and interests of film and television works to achieve development. To solve these problems, we must find out the balance between copyright owners, network end users and network content service providers, while fully protecting the interests of copyright owners of film and television works under the network environment. It can also satisfy the network end users from the network content service provider legal, reasonable appreciation of outstanding literary and artistic film and television works, but also promote the network content service providers of sustainable and healthy development. This issue has become a hot issue in the research of copyright system in various countries.
