論電子商務(wù)中商標(biāo)權(quán)的法律保護(hù)

【摘要】:電子商務(wù)作為科學(xué)技術(shù)發(fā)展環(huán)境下的一種新交易模式在全球范圍內(nèi)得到快速發(fā)展。電子商務(wù)網(wǎng)站作為電子商務(wù)貿(mào)易的平臺與載體,對電子商務(wù)的發(fā)展發(fā)揮著至關(guān)重要的作用,但也因互聯(lián)網(wǎng)虛擬性等特點侵害了相關(guān)商標(biāo)權(quán)人的合法權(quán)益。為了保障電子商務(wù)行業(yè)健康有序的發(fā)展,電子商務(wù)平臺自身要履行自己的注意義務(wù),在法律規(guī)定的義務(wù)范圍內(nèi)注意侵犯商標(biāo)權(quán)的情況,并按照法律相關(guān)規(guī)定做出回應(yīng)。在出現(xiàn)相關(guān)商標(biāo)權(quán)糾紛時,司法機(jī)關(guān)按照法律規(guī)定,合理判定相關(guān)責(zé)任的承擔(dān)。同時,立法機(jī)關(guān)應(yīng)積極通過立法、修法等手段完善相關(guān)法律法規(guī),適應(yīng)電子商務(wù)發(fā)展趨勢。才能不斷減少司法實踐中電子商務(wù)平臺侵犯商標(biāo)權(quán)的事件發(fā)生,避免對商標(biāo)權(quán)人利益的損害,促進(jìn)電子商務(wù)行業(yè)的良性發(fā)展。本文將從以下角度對電子商務(wù)商標(biāo)權(quán)保護(hù)進(jìn)行研究。首先,對電子商務(wù)與商標(biāo)權(quán)的基礎(chǔ)概念進(jìn)行介紹并進(jìn)一步分析了電子商務(wù)的發(fā)展對商標(biāo)權(quán)保護(hù)所產(chǎn)生的影響以及電子商務(wù)商標(biāo)權(quán)保護(hù)的相關(guān)理論。其次,對電子商務(wù)中商標(biāo)權(quán)保護(hù)的現(xiàn)狀和問題進(jìn)行闡述,主要從電子商務(wù)商標(biāo)權(quán)保護(hù)范圍的界定、侵權(quán)認(rèn)定的現(xiàn)狀以及侵權(quán)救濟(jì)的現(xiàn)狀角度進(jìn)行介紹。最后,在分析電子商務(wù)中商標(biāo)權(quán)保護(hù)的現(xiàn)狀和問題的基礎(chǔ)上,提出了對電子商務(wù)商標(biāo)權(quán)保護(hù)的完善建議。綜上所述,電子商務(wù)的健康發(fā)展離不開法律的規(guī)制以及相關(guān)參與者對法律義務(wù)的承擔(dān),由此才能保護(hù)商標(biāo)權(quán)利人的合法權(quán)益,從而維護(hù)電子商務(wù)市場健康有序的發(fā)展。
[Abstract]:E-commerce, as a new transaction mode in the environment of science and technology development, has been developed rapidly in the world. As the platform and carrier of e-commerce trade, E-commerce website plays a vital role in the development of e-commerce, but also infringes on the legal rights and interests of relevant trademark owners because of the characteristics of Internet virtualization. In order to ensure the healthy and orderly development of the e-commerce industry, the e-commerce platform itself should fulfill its duty of care, pay attention to the infringement of trademark rights within the scope of the obligations stipulated by the law, and respond in accordance with the relevant provisions of the law. In the event of trademark disputes, the judicial organs, in accordance with the provisions of the law, a reasonable determination of the relevant responsibilities. At the same time, the legislature should actively improve the relevant laws and regulations by means of legislation and amendment to adapt to the development trend of electronic commerce. Only in order to reduce the occurrences of the infringement of trademark rights by e-commerce platform in judicial practice, to avoid the damage to the interests of trademark owners, and to promote the benign development of the electronic commerce industry. This article will carry on the research from the following angle to the e-commerce trademark right protection. Firstly, this paper introduces the basic concepts of electronic commerce and trademark rights, and further analyzes the influence of the development of electronic commerce on the protection of trademark rights, as well as the relevant theories of the protection of trademark rights in electronic commerce. Secondly, the status quo and problems of trademark right protection in electronic commerce are expounded, mainly from the definition of the scope of protection of trademark rights in electronic commerce, the status quo of tort recognition and the current situation of tort relief. Finally, on the basis of analyzing the current situation and problems of trademark right protection in electronic commerce, the author puts forward some suggestions to improve the protection of trademark right in electronic commerce. To sum up, the healthy development of electronic commerce can not be separated from the regulation of law and the commitment of relevant participants to the legal obligations, so as to protect the legitimate rights and interests of trademark holders, and thus maintain the healthy and orderly development of electronic commerce market.
