【摘要】：少數(shù)民族非物質(zhì)文化遺產(chǎn)作為文化瑰寶有著重要的文化經(jīng)濟(jì)價值�？紤]到非物質(zhì)文化遺產(chǎn)自身的非物質(zhì)性以及活態(tài)傳承的特點,傳承主體發(fā)揮著重要作用。非物質(zhì)文化遺產(chǎn)傳承主體多數(shù)以群體形式存在,一起肩負(fù)著非遺傳承的重?fù)?dān)。當(dāng)前非遺傳承保護(hù)面臨眾多困難,這些都和傳承主體權(quán)利保護(hù)缺失存在緊密聯(lián)系。不管是國家還是地方立法,對非遺傳承主體私權(quán)保護(hù)較弱,傳承主體的權(quán)利、地位都難以獲得法律救濟(jì),因此,從民商法視角下確立少數(shù)民族非遺傳承主體權(quán)利保障機(jī)制,有助于提高法律權(quán)利保障水平。
[Abstract]:As a cultural treasure, the intangible cultural heritage of ethnic minorities has important cultural and economic value. Considering the immateriality of intangible cultural heritage and the characteristics of living state inheritance, the main body of inheritance plays an important role. The main body of intangible cultural heritage inherits mostly in the form of group, bearing the burden of non-inheritance together. At present, the protection of non-inheritance is faced with many difficulties, which are closely related to the lack of protection of the rights of the inheritance subject. Whether it is national or local legislation, the protection of private rights of non-inheritance subjects is weak, and the rights and status of inheritance subjects are difficult to obtain legal relief. Therefore, from the perspective of civil and commercial law, it is difficult to establish the protection mechanism of the rights of minority non-inheritance subjects. It helps to improve the level of protection of legal rights.
