【摘要】：戲仿是版權保護的重要文藝批評形式。數(shù)字時代,對已有版權作品進行再詮釋和混搭創(chuàng)作成為文學藝術的主要表達之一,而合理使用是版權法中唯一使這種表達形式合法化的規(guī)則通道。美國司法實踐表明,戲仿構成合理使用的條件進一步降低;英國也于2014年在修訂版權法合理使用制度時增加"戲仿"一條。雖然目前中國在此方面缺乏司法實踐,但是西方國家在戲仿理論與實踐方面的經(jīng)驗值得借鑒。在承認戲仿作為一種藝術形式值得版權保護的基礎上,將可得到版權保護的戲仿限定在對原作或其他作品進行批評或評論的范圍內(nèi),并要求原作作者在作者權方面做出一定的讓步。
[Abstract]:Parody is an important form of literary and art criticism for copyright protection. In the digital age, reinterpretation of existing copyrighted works and mixed creation has become one of the main expressions of literature and art, and rational use is the only regular channel in copyright law to legalize this form of expression. Judicial practice in the United States has shown that parody constitutes a further reduction in the conditions for rational use, and the United Kingdom added a parody in 2014 when revising the fair use system of copyright law. Although there is a lack of judicial practice in China at present, the experience of western countries in parody theory and practice is worthy of reference. Recognizing that parody is worthy of copyright protection as an artistic form, limiting copyrighted parody to criticism or comment on the original or other works, And ask the original author to make certain concessions in the author's rights.
