【摘要】：21世紀(jì)是人口老齡化的時(shí)代。中國早在1999年就已經(jīng)進(jìn)入了老齡社會,是發(fā)展中國家中比較早進(jìn)入老齡化社會的。中國是世界上老年人口最多的國家,中國人口老齡的問題不僅是中國自身的問題,也關(guān)系到整個(gè)世界的老齡化進(jìn)程,因此備受關(guān)注。隨著老齡化進(jìn)程的加速,我國老年人作為弱勢群體應(yīng)當(dāng)受到國家廣泛關(guān)注及幫助。目前,我國僅有一些很少的條文提及老年人監(jiān)護(hù)問題,并涉及范圍小,條文分散,內(nèi)容空泛,對于真正老年人的監(jiān)護(hù)起到很小的作用。在德國修改過后的照管制度中,對于老年人監(jiān)護(hù)提出很多有效的見解,這對于我國解決老年人存在的問題,并建立起我國自己老年人監(jiān)護(hù)制度來說有著童要的借鑒意義。 文章第一部分主要分析了我國當(dāng)前相關(guān)的立法現(xiàn)狀。我國有關(guān)老年人監(jiān)護(hù)制度的立法主要在《民法通則》和《老年人權(quán)益保障法》中有提到,但僅有很小條文規(guī)定,且并不具體。 文章第二部分主要針對我國老年人監(jiān)護(hù)具體存在哪些問題進(jìn)行分析。我國老年人監(jiān)護(hù)制度當(dāng)前面臨著立法理念落后、意定監(jiān)護(hù)的缺失、監(jiān)護(hù)人任職資格不明確、監(jiān)護(hù)對象范圍狹窄等許多問題,這些問題都亟待解決。 文章第三部分主要是對德國照管制度相關(guān)內(nèi)容進(jìn)行介紹,并總結(jié)照管制度有哪些經(jīng)驗(yàn)是值得我國借鑒的。德國在修改過后的照管制度,由監(jiān)護(hù)轉(zhuǎn)為照管,立法理念的進(jìn)步、照管對象的范圍擴(kuò)大等多方面內(nèi)容都值得我國學(xué)習(xí)和借鑒。 文章最后一部分主要針對我國當(dāng)前面對的老年人監(jiān)護(hù)的問題,提出構(gòu)建我國專門的老年人監(jiān)護(hù)制度的相關(guān)立法建議。建議主要從立法理念的更新、法定老年人具體制度的完善以及設(shè)立意定監(jiān)護(hù)制度上去完善。
[Abstract]:The 21 st century is the age of aging population. China entered an aging society as early as 1999. China has the largest aging population in the world. The problem of aging in China is not only its own problem, but also related to the aging process of the whole world. With the acceleration of the aging process, the elderly in China, as a vulnerable group, should receive extensive attention and help from the country. At present, there are only a few articles about the guardianship of the elderly in our country, and the scope is small, the articles are scattered and the contents are vague, which plays a very small role in the guardianship of the real elderly. In the revised care system of Germany, a lot of effective opinions are put forward for the elderly guardianship, which is of great significance to solve the problems existing in the elderly in our country and to set up our own guardianship system for the elderly. The first part of the article mainly analyzes the current legislation situation of our country. The legislation on the guardianship system of the elderly in China is mainly mentioned in the General principles of Civil Law and the Law on the Protection of the Rights and interests of the elderly, but there are only a few provisions, which are not specific. The second part of the article mainly analyzes the problems of the elderly guardianship in China. At present, China's elderly guardianship system is faced with many problems, such as the backward legislative concept, the absence of voluntary guardianship, the unclear qualification of guardianship, the narrow range of guardianship objects, and so on. These problems need to be solved urgently. The third part mainly introduces the relevant contents of care system in Germany and sums up the experience of care system in China. Germany's revised care system, from guardianship to care, the progress of legislative ideas, the scope of care objects, and other aspects of the contents are worthy of our country to learn and learn from. In the last part of the article, the author puts forward some legislative suggestions on how to construct a special guardianship system for the elderly in view of the current problems of the elderly guardianship in our country. The suggestion mainly from the legislation idea renewal, the legal old person concrete system consummation as well as the establishment will decide the guardianship system to consummate.
