論我國公眾人物隱私權(quán)與大眾知情權(quán)的沖突與協(xié)調(diào)

【摘要】:隨著小康社會的全面建設(shè),社會公眾對個人隱私的保護(hù)意識有很大程度的提高,但同時又對他人的隱私尤其是公眾人物的隱私有著極強(qiáng)的興趣。相比普通公眾,公眾人物擁有更高的社會地位和知名度,他們可以獲得更高的利益,作為代價,他們的隱私權(quán)就會受到更多的限制,即對媒體曝光他們的隱私在一定范圍內(nèi)有容忍的義務(wù)。而新聞媒介的報道,已經(jīng)成為公民行使知情權(quán)的主要途徑之一,為滿足公眾好奇心,提高“收視率”、“發(fā)行量”在對公眾人物進(jìn)行報道時,出現(xiàn)大量侵犯公眾人物隱私權(quán)的行為,使得公眾人物隱私權(quán)與大眾知情權(quán)的矛盾日漸突出,基于此,針對這一權(quán)利沖突問題展開研究。本文首先介紹研究背景及意義、國內(nèi)外學(xué)術(shù)界的研究動態(tài),從“公眾人物”、“公眾人物隱私權(quán)”、“知情權(quán)”等基本概念入手指出公眾人物隱私權(quán)與大眾知情權(quán)沖突的內(nèi)在原因;其次,對國外關(guān)于協(xié)調(diào)權(quán)利沖突的具體規(guī)定和理念做法進(jìn)行闡述,從而汲取優(yōu)秀經(jīng)驗;再次對現(xiàn)階段我國關(guān)于公眾人物隱私權(quán)及大眾知情權(quán)的立法現(xiàn)狀進(jìn)行說明分析,進(jìn)而提出其中的問題;最后,在所提出的問題的基礎(chǔ)上,對協(xié)調(diào)我國公眾人物隱私權(quán)與大眾知情權(quán)沖突提出所應(yīng)遵循的基本原則,并從立法途徑、司法途徑和社會途徑三個方面提出了協(xié)調(diào)權(quán)利沖突的建議與對策。
[Abstract]:With the overall construction of a well-off society, the public's awareness of the protection of personal privacy has been greatly improved, but at the same time, the privacy of others, especially the privacy of public figures, has a strong interest. Compared with the general public, public figures have a higher social status and visibility, they can obtain higher benefits, as a price, their privacy rights will be more restricted. That is, the media exposure of their privacy within a certain scope of the obligation to tolerate. However, news media reports have become one of the main ways for citizens to exercise their right to know. In order to satisfy public curiosity and improve the "ratings", "circulation" is used to report on public figures. A large number of violations of the right to privacy of public figures make the contradiction between the privacy of public figures and the public right to know become more and more prominent. Based on this, the conflict of this right is studied. This article first introduces the research background and significance, the domestic and foreign academic circles research tendency, from "the public figure", "the public figure privacy", Starting with the basic concepts of "the right to know", the author points out the internal causes of the conflict between the right to privacy of public figures and the right to know of the public. Thirdly, it explains and analyzes the current legislative situation of the right to privacy of public figures and the right to know of the public in our country, and then puts forward some problems. Finally, on the basis of the questions raised, This paper puts forward the basic principles to coordinate the conflict between the right to privacy of public figures and the right to know of the public in our country, and puts forward some suggestions and countermeasures to coordinate the conflict of rights from three aspects: legislative approach, judicial approach and social approach.
