中國城市住宅建設(shè)用地使用權(quán)自動續(xù)期研究

【摘要】：《中共中央國務(wù)院關(guān)于完善產(chǎn)權(quán)保護(hù)制度依法保護(hù)產(chǎn)權(quán)意見》于2016年11月27日正式對外發(fā)布,這是我國首次以中央名義出臺的產(chǎn)權(quán)保護(hù)頂層設(shè)計,《意見》明確規(guī)定,研究住宅建設(shè)用地等土地使用權(quán)到期后的法律安排,這標(biāo)志著我國城市住宅型建設(shè)用地使用權(quán)以何種方法自動續(xù)期已是一個急需解決的問題。城市住宅型建設(shè)用地使用權(quán)續(xù)期問題的妥善解決既牽動著國家產(chǎn)權(quán)保護(hù)頂層設(shè)計,同時也關(guān)乎到每一個城市住宅類建設(shè)用地使用權(quán)人的切身利益。在住宅建設(shè)用地等土地使用權(quán)到期后的法律安排呼之欲出之際,本文首先運(yùn)用文獻(xiàn)分析法,對我國城市建設(shè)用地使用權(quán)期限不同時代立法規(guī)定的變化和不同學(xué)者對建設(shè)用地使用權(quán)屆滿自動續(xù)期的觀點(diǎn)進(jìn)行梳理,闡釋我國立法者對城市建設(shè)用地使用權(quán)期限規(guī)定的立法目的。接著運(yùn)用案例分析法對青島、溫州兩個建設(shè)用地使用權(quán)撞限的住宅物業(yè)的實(shí)際解決方案進(jìn)行分析,從中找到當(dāng)?shù)貙Τ鞘薪ㄔO(shè)用地使用期續(xù)期問題解決的不合理處、同《物權(quán)法》中對城市建設(shè)用地使用權(quán)續(xù)期的立法本意相違背之處,同時提出急需妥善解決的關(guān)鍵點(diǎn)。最后本文運(yùn)用比較分析法通過對德國、日本、中國臺灣、英國、中國香港住宅產(chǎn)權(quán)續(xù)期的實(shí)際方案進(jìn)行分析,在權(quán)衡其中各種利弊后,提出適合我國國情并也符合《物權(quán)法》中關(guān)于城市建設(shè)用地使用權(quán)自動續(xù)期立法本意的建議。
[Abstract]:The "opinions of the CPC Central Committee and the State Council on perfecting the system of property right Protection in accordance with the Law" was officially issued to the public on November 27, 2016. This is the first top-level design for property rights protection in the name of the central government in China. This paper studies the legal arrangement after the expiration of land use right such as residential construction land, which indicates that the method of automatic renewal of urban residential construction land use right in China is an urgent problem to be solved. The proper solution to the renewal of the right to use urban residential construction land not only affects the top-level design of national property right protection, but also relates to the vital interests of every person who uses urban residential construction land. When the legal arrangement after the expiration of land use right, such as residential construction land, this paper first uses the literature analysis method. This paper combs the changes of the legislative provisions in different times of the term of the right to use urban construction land in China and the views of different scholars on the automatic renewal of the right to the use of construction land. The legislative purpose of legislator on the term of the right to use urban construction land is explained. Then using the case analysis method to analyze the actual solution of the residential property which is limited by the right to use the construction land in Qingdao and Wenzhou, and find out the unreasonable solution to the renewal problem of the urban construction land use period. It is contrary to the original legislative intention of the renewal of the right to use urban construction land in the Real right Law, and puts forward the key points that need to be solved properly at the same time. Finally, this paper uses comparative analysis method to analyze the actual plan of renewal of residential property right in Germany, Japan, Taiwan, Britain and Hong Kong, China. After weighing the advantages and disadvantages, This paper puts forward some suggestions on the legislative intention of automatic renewal of the right to use urban construction land, which is suitable for the national conditions of our country and is also in line with the original legislative intent of the right to use urban construction land.
