【摘要】：專利權(quán)是一種私權(quán),專利制度追求創(chuàng)新和發(fā)展;而標(biāo)準(zhǔn)是一種公共產(chǎn)品,其內(nèi)在的要求是統(tǒng)一性和普適性。專利和標(biāo)準(zhǔn)的結(jié)合必然伴隨著許多沖突和問題,其中專利許可問題因其發(fā)現(xiàn)早、發(fā)展快的特點已成為專利標(biāo)準(zhǔn)化進(jìn)程中的核心問題,對標(biāo)準(zhǔn)的推廣和實施形成了制約。本文認(rèn)為,標(biāo)準(zhǔn)制定機(jī)構(gòu)的事前協(xié)調(diào)機(jī)制對于解決標(biāo)準(zhǔn)中的專利許可問題十分關(guān)鍵。標(biāo)準(zhǔn)制定機(jī)構(gòu)作為帶有公共屬性的組織機(jī)構(gòu),在制定標(biāo)準(zhǔn)之余,也應(yīng)當(dāng)適當(dāng)參與和介入標(biāo)準(zhǔn)化中的專利許可問題,以確保標(biāo)準(zhǔn)化中專利許可的順利實施。本文共分四部分論述,第一部分對專利與標(biāo)準(zhǔn)的關(guān)系作了簡要論述,包括標(biāo)準(zhǔn)的概念和分類,標(biāo)準(zhǔn)和專利結(jié)合后產(chǎn)生的問題,并著重介紹了標(biāo)準(zhǔn)制定機(jī)構(gòu)與專利許可相關(guān)的基本政策。第二部分是標(biāo)準(zhǔn)中專利信息確認(rèn)問題的分析與解決。第三部分是專利許可實施的標(biāo)準(zhǔn)管理機(jī)構(gòu)之選用。第四部分介紹了標(biāo)準(zhǔn)化中專利許可條件的不確定性及解決方案。第五部分是標(biāo)準(zhǔn)化中專利許可糾紛的解決,主要介紹了標(biāo)準(zhǔn)制定機(jī)構(gòu)在糾紛中的定位和參與方式。第六部分介紹了我國標(biāo)準(zhǔn)制定機(jī)構(gòu)和標(biāo)準(zhǔn)管理體系的特殊屬性,對我國標(biāo)準(zhǔn)化中專利許可問題的現(xiàn)狀進(jìn)行了分析并提出相應(yīng)改善建議。
[Abstract]:Patent right is a kind of private right, patent system pursues innovation and development, and standard is a kind of public goods, its inherent requirement is unity and universality. The combination of patent and standard is bound to be accompanied by many conflicts and problems, among which the problem of patent license has become the core problem in the process of patent standardization because of its early discovery and rapid development, which has restricted the popularization and implementation of the standard. This paper holds that the prior coordination mechanism of the standard setting organization is very important to solve the patent licensing problem in the standard. As an organization with public attributes, standard-setting organizations should also participate in and intervene in patent licensing issues in standardization, so as to ensure the smooth implementation of patent licenses in standardization. This paper is divided into four parts. The first part briefly discusses the relationship between patent and standard, including the concept and classification of standard, the problems arising from the combination of standard and patent. The basic policies of standard-setting organization and patent license are introduced emphatically. The second part is the analysis and solution of patent information confirmation in the standard. The third part is the selection of the standard management organization of patent licensing. The fourth part introduces the uncertainty and solution of patent licensing conditions in standardization. The fifth part is the resolution of patent licensing disputes in standardization, mainly introduces the positioning and participation of standard-setting organizations in disputes. The sixth part introduces the special attributes of China's standard-setting organization and standard management system, analyzes the current situation of patent licensing in China's standardization and puts forward corresponding suggestions for improvement.
