【摘要】：作品利益的公平分配,是著作權(quán)法所關(guān)注的重要問題。特別是在視聽作品增值利益產(chǎn)生之后,作者公平獲酬權(quán)的缺失會(huì)導(dǎo)致利益分配矛盾的激化。大陸法系國家對作者利益的偏袒,以及英美法系國家對投資者利益的過度保護(hù),都沒能很好地解決這一問題。針對視聽作品的利益分配,應(yīng)當(dāng)以按要素分配理論為基礎(chǔ),將視聽作品利益的構(gòu)成要素進(jìn)行細(xì)分,衡量各主體的要素貢獻(xiàn),并以各要素的貢獻(xiàn)作為利益分配的主要依據(jù)。其中,作者的創(chuàng)造要素是作品得以產(chǎn)生的根源,因而需要在著作權(quán)法中明確規(guī)定:唯有創(chuàng)造要素投入的主體才能成為作者。同時(shí),應(yīng)當(dāng)賦予作者公平的獲酬權(quán),包括二次獲酬的權(quán)利。只有依照按要素分配理論,進(jìn)一步完善著作權(quán)法中的公平獲酬制度,才能切實(shí)保障視聽作品的利益分配公平。
[Abstract]:Fair distribution of the interests of works is an important issue of copyright law. Especially after the value-added interest of audio-visual works comes into being, the absence of the author's right to fair remuneration will lead to the intensification of contradictions in the distribution of interests. The favoritism of the author's interests in the civil law countries and the over-protection of the investors' interests in the common law system countries have not solved this problem well. In view of the distribution of interests of audio-visual works, we should subdivide the constituent elements of the interests of audio-visual works on the basis of the theory of distribution of elements, measure the contribution of elements of each subject, and take the contribution of each element as the main basis for the distribution of interests. Among them, the creative elements of the author are the root of the creation of the work, so it needs to be clearly stipulated in the copyright law that only the subject of the input of the creative elements can become the author. At the same time, the author should be given a fair right to be paid, including the right to second pay. Only in accordance with the theory of distribution according to elements and further perfecting the system of fair remuneration in copyright law can the interests of audio-visual works be effectively protected.
