【摘要】：在信息時代,隨著信息技術的快速發(fā)展和互聯(lián)網(wǎng)使用范圍的逐漸擴大,網(wǎng)絡給人們帶來了很大的便利,使得人們的工作、生活、學習有了很大的轉變。同時網(wǎng)絡對于經(jīng)濟、政治等各個方面都起著很重要的作用�，F(xiàn)如今各個行業(yè)在網(wǎng)上收集信息的速度和能力不斷提升,信息傳播的數(shù)量和速度也產(chǎn)生了驚人的增長,我們在網(wǎng)絡面前成為毫無隱私的“透明人”。網(wǎng)絡隱私權問題日益凸顯,現(xiàn)在越來越多的網(wǎng)站里儲存的都是大家真實的個人信息數(shù)據(jù),公民的私人信息面臨著被非法收集、利用的危險,網(wǎng)絡隱私被暴露在社會和公眾的視野之下,隱私權受到嚴重的威脅。但是我國現(xiàn)在對于網(wǎng)絡隱私權保護尚存在欠缺,使得公民在隱私權受到侵害的時候難以拿起法律武器維護自己的合法權益。因此我們應高度重視網(wǎng)絡隱私侵權問題,并積極探索解決方案,切實保障公民的網(wǎng)絡隱私權。本文將從以下幾個方面來對此內(nèi)容進行闡述。第一部分對網(wǎng)絡隱私權的基本情況進行了介紹,闡釋了網(wǎng)絡隱私面臨的威脅及其侵權表現(xiàn)形式,并從法理層面對網(wǎng)絡隱私權的保護進行了分析。第二部分通過對我國網(wǎng)絡隱私權的法律保護現(xiàn)狀進行分析,揭示出現(xiàn)階段我國存在的問題。第三部分對國外網(wǎng)絡隱私權的法律保護現(xiàn)狀進行了比較分析,主要介紹了歐盟、英國、美國、日本關于網(wǎng)絡隱私權的保護現(xiàn)狀,并從中得到一定的啟示。第四部分借鑒國外對于網(wǎng)絡隱私權保護的成熟經(jīng)驗,從我國實際出發(fā),提出我國的網(wǎng)絡隱私權法律保護的對策建議。
[Abstract]:In the information age, with the rapid development of information technology and the gradual expansion of the scope of use of the Internet, the network has brought great convenience to people, making people's work, life, learning have a great change. At the same time, the network plays an important role in economy, politics and other aspects. Nowadays, the speed and ability of collecting information on the Internet has been improved, and the quantity and speed of information dissemination has increased dramatically. We have become a "transparent person" with no privacy in front of the Internet. The problem of network privacy is becoming increasingly prominent. Now more and more websites store real personal information data, and private information of citizens is in danger of being illegally collected and utilized. Internet privacy is exposed to the social and public vision, privacy is seriously threatened. However, there are still some deficiencies in the protection of network privacy in our country, which makes it difficult for citizens to take up legal weapons to safeguard their legitimate rights and interests when the right to privacy is violated. Therefore, we should attach great importance to network privacy infringement, and actively explore solutions to ensure citizens' network privacy. This article will explain this content from the following several aspects. The first part introduces the basic situation of network privacy, explains the threat to network privacy and its forms of infringement, and analyzes the protection of network privacy from the legal perspective. The second part analyzes the current situation of the legal protection of the right to network privacy in our country, and reveals the problems existing in our country. The third part makes a comparative analysis of the status quo of the legal protection of the right to network privacy in foreign countries, mainly introduces the status quo of the protection of the right to network privacy in the European Union, the United Kingdom, the United States and Japan, and gets some enlightenment from it. The fourth part draws lessons from the mature experience of foreign countries for the protection of network privacy and puts forward the countermeasures and suggestions for the legal protection of the right to network privacy from the point of view of the reality of our country.
