【摘要】："人格權(quán)"是一個關(guān)系到民法典整體結(jié)構(gòu)與立法進程的法律問題,需要展開更加深入細致的研究。作為肇始于西方的概念,對國外先進人格權(quán)制度的吸收與借鑒是我國相應(yīng)制度建設(shè)的重要途徑。中國特色法治體系的構(gòu)筑,必須堅持從本國國情出發(fā),汲取中華法律文化精華�？疾旆蓚鹘y(tǒng)中的內(nèi)在人格權(quán)制度因素,需要立足中國古代身份制度這一土壤,具體分析傳統(tǒng)法律對人格利益的保護與法律文化所蘊含的倫理道德基礎(chǔ)。同時,結(jié)合域外理論范式與我國百年立法經(jīng)驗,支持人格權(quán)法獨立成編,否定一般人格權(quán)制度,并對人格權(quán)類型化作出簡要分析,以期構(gòu)建具有中國特色的人格權(quán)制度體系。
[Abstract]:Personality right is a legal problem related to the whole structure and legislative process of the Civil Code. As a concept that originated in the west, absorbing and drawing lessons from the foreign advanced personality right system is an important way to construct the corresponding system in our country. The construction of the legal system with Chinese characteristics must be based on the national conditions and absorb the essence of Chinese legal culture. To investigate the internal factors of personality right system in the legal tradition, it is necessary to base on the soil of ancient Chinese identity system, and to analyze the protection of personality interests and the ethical and moral basis contained in the legal culture. At the same time, combining with the extraterritorial theoretical paradigm and our country's legislative experience of one hundred years, the author supports the independent compilation of personality right law, negates the general personality right system, and makes a brief analysis of the personality right type, in order to construct the personality right system with Chinese characteristics.
