【摘要】：在技術(shù)標準被采用之后,標準必要專利權(quán)利人獲得了市場支配地位。為了防止壟斷,標準組織通常要求標準必要專利權(quán)利人,作出"公平、合理和無歧視(FRAND)"承諾。但是,專利權(quán)人將標準必要專利轉(zhuǎn)讓之后,FRAND承諾是否具有法律效力,這個問題鮮有討論。英國"無線星球訴三星案"表明FRAND承諾具有普遍約束力,該案值得我國參考與借鑒。
[Abstract]:After the adoption of technical standards, the patentee of the necessary standard acquired a dominant position in the market. In order to prevent monopolies, standards organizations usually require the necessary patent holders to make "fair, reasonable and non-discriminatory (FRAND)" commitments. However, there is little discussion about the legal validity of the FRAND undertaking after the patentee has transferred the standard necessary patent. The case of Wireless Planet v. Samsung shows that the FRAND commitment is universally binding, and this case is worthy of our reference and reference.
