【摘要】：3D數(shù)字模型是3D打印中最為核心的要素,用戶主要通過CAD軟件設(shè)計(jì)或3D掃描獲得3D數(shù)字模型。具有獨(dú)創(chuàng)性的3D數(shù)字模型可以作為美術(shù)作品或圖形作品受到著作權(quán)的保護(hù)。對(duì)3D數(shù)字模型的復(fù)制表現(xiàn)為不改變作品載體表現(xiàn)方式的復(fù)制和從平面到立體的復(fù)制。其中,對(duì)構(gòu)成美術(shù)作品的3D數(shù)字模型進(jìn)行打印屬于平面到立體的復(fù)制,而對(duì)構(gòu)成產(chǎn)品設(shè)計(jì)圖的3D數(shù)字模型的打印不構(gòu)成著作權(quán)法意義上的復(fù)制。在現(xiàn)行著作權(quán)法框架內(nèi),建議通過成立著作權(quán)集體管理組織、采用著作權(quán)技術(shù)保護(hù)措施和限制私人復(fù)制范圍等方式對(duì)3D數(shù)字模型的復(fù)制權(quán)進(jìn)行保護(hù)。
[Abstract]:The 3D digital model is the most important element in 3D printing. The user mainly obtains the 3D digital model through the CAD software design or the 3D scanning. The original 3D digital model can be protected as the copyright of the art works or graphic works. The replication of the 3D digital model is the replication and the leveling of the expression of the unaltered works carrier. The printing of the 3D digital model which constitutes the art works belongs to the copy of the plane to the three-dimensional, and the printing of the 3D digital model which constitutes the product design map does not constitute the copy of the copyright law. In the framework of the current copyright law, it is suggested that the copyright collective management organization should be adopted by the collective management organization, and the copyright technology is adopted. The right to reproduce the 3D digital model is protected by means of protective measures and restrictions on the scope of private copying.
