【摘要】：從近幾年發(fā)生的字庫(kù)侵權(quán)的案件來(lái)看,司法實(shí)踐中對(duì)于計(jì)算機(jī)字體、字庫(kù)的作品屬性是什么、以及字庫(kù)保護(hù)范圍的界定各不相同,做出的裁判也互相矛盾。這樣很容易造成司法混亂不統(tǒng)一的局面,影響了司法權(quán)威也不利于糾紛的解決。此外,還可能嚴(yán)重?fù)p害字庫(kù)設(shè)計(jì)研發(fā)企業(yè)的利益,不利于我國(guó)字庫(kù)行業(yè)的發(fā)展。在理論界和實(shí)務(wù)界對(duì)字庫(kù)的保護(hù)是達(dá)成共識(shí)的,那就是字庫(kù)值得保護(hù)。但對(duì)于字庫(kù)的保護(hù)程度卻存在很大的爭(zhēng)議。本文通過(guò)對(duì)近年發(fā)生的幾個(gè)典型的字庫(kù)及字體侵權(quán)案件的分析,主要從五個(gè)方面對(duì)計(jì)算機(jī)字庫(kù)及字體的著作權(quán)保護(hù)進(jìn)行研究。第一部分,通過(guò)近幾年發(fā)生的計(jì)算機(jī)字庫(kù)及字體著作權(quán)侵權(quán)案件,來(lái)探求該類案件在司法實(shí)踐中存在的問(wèn)題及爭(zhēng)議；第二部分,針對(duì)第一部分的爭(zhēng)議焦點(diǎn)問(wèn)題進(jìn)行法律分析：主要分析我國(guó)計(jì)算機(jī)字庫(kù)的法律屬性、計(jì)算機(jī)字庫(kù)中的單個(gè)字體的法律屬性,計(jì)算機(jī)字庫(kù)以及字庫(kù)中的單個(gè)字形是否可以享有著作權(quán)等問(wèn)題；第三部分,根據(jù)第二部分的分析,在現(xiàn)行《著作權(quán)法》及相關(guān)法律規(guī)范沒(méi)有明確規(guī)定如何保護(hù)計(jì)算機(jī)字庫(kù)及字體的前提下,如何來(lái)認(rèn)定計(jì)算機(jī)字體、字庫(kù)的侵權(quán),主要分析在認(rèn)定侵權(quán)過(guò)程中存在的障礙；侵權(quán)的主要形式以及侵權(quán)的認(rèn)定標(biāo)準(zhǔn)；第四部分,考察外國(guó)法對(duì)計(jì)算機(jī)字體、字庫(kù)法律保護(hù)方面的相關(guān)做法,并進(jìn)行簡(jiǎn)要分析比較；第五部分,借鑒外國(guó)法對(duì)計(jì)算機(jī)字體、字庫(kù)的保護(hù)的相關(guān)經(jīng)驗(yàn)并根據(jù)我國(guó)的實(shí)際情況進(jìn)行分析,進(jìn)而提出完善我國(guó)計(jì)算機(jī)字庫(kù)、字體法律保護(hù)的可行性建議。
[Abstract]:Judging from the cases of font infringement in recent years, in judicial practice, the definition of computer font, the property of the works of the font and the scope of the font protection are different, and the judgment made is also contradictory. This will easily lead to judicial confusion and disunity, affecting the judicial authority is not conducive to the resolution of disputes. In addition, it may seriously damage the interests of font design and R & D enterprises, and is not conducive to the development of Chinese font industry. In the theoretical and practical circles, there is a consensus on the protection of the font, that is, the font is worth protecting. However, there is a great controversy about the protection of the font. Based on the analysis of several typical font infringement cases in recent years, this paper mainly studies the copyright protection of computer fonts and fonts from five aspects. The first part, through the computer font and font copyright infringement cases occurred in recent years, to explore this kind of cases in the judicial practice of the problems and disputes; the second part, The first part of the dispute focus of the legal analysis: mainly analyzes the legal attributes of the computer font in our country, the legal attributes of a single font in the computer font, Whether the computer font and the individual font in the font can enjoy copyright or not; part three, according to the analysis of the second part, In the current copyright Law and related laws and regulations have not clearly stipulated how to protect the computer font and font premise, how to identify the computer font, font infringement, mainly analyzes the obstacles in the process of copyright infringement; The main forms of infringement and the standards of tort; the fourth part, the investigation of foreign laws on computer fonts, font protection related practices, and a brief analysis of the comparison; part five, drawing lessons from foreign laws on computer fonts, According to the actual situation of our country, this paper puts forward some feasible suggestions on how to perfect the legal protection of computer font and font in our country.
