奧林匹克標志的知識產(chǎn)權保護研究

【摘要】:奧運會是全世界的體育盛事,它不只涉及體育,從經(jīng)濟、文化到法律,都與奧運息息相關。面對奧運會的巨大商機,商家紛紛想到利用這一時機宣傳自己,但如果方式不當,侵權行為也就隨之產(chǎn)生,其中最典型的就是侵犯奧林匹克標志的知識產(chǎn)權。自2002年北京三年查獲199起奧林匹克標志侵權案,侵犯奧林匹克標志的知識產(chǎn)權,不僅表現(xiàn)為不法商家直接侵犯奧林匹克標志的專有銷售權,還包括利用隱性營銷的方式打“擦邊球”,侵犯奧運會合作伙伴的專有排他權。如何保護奧林匹克標志知識產(chǎn)權權利人的合法權利,維護奧運會尊嚴,保持奧林匹克精神的純凈性,成為一個亟待解決的問題。奧林匹克標志的知識產(chǎn)權保護并不是一開始就存在。在奧運會發(fā)展早期,由于各項制度并不完善,奧運會并沒有建立起固定的標志,因此并不存在奧運會標志產(chǎn)品的知識產(chǎn)權保護問題。1980年西班牙人薩馬蘭奇接任奧委會主席后,進行一系列大刀闊斧的改革,正式將奧運會引入一個全新的經(jīng)濟發(fā)展模式,并建立了影響重大的TOP計劃The Olympic Programme)。這才使得對奧林匹克標志的保護提上日程。我國《奧林匹克標志保護條例》的頒布,標志著對奧林匹克標志保護進行法律保護,《條例》共15條,于2002年2月4日由國務院發(fā)布,同年4月1日起施行,至今已經(jīng)實施九周年。本文分析了我國奧林匹克標志知識產(chǎn)權的權利屬性以及國內(nèi)保護現(xiàn)狀,指出我國奧林匹克標志法律保護的局限性,表現(xiàn)為專門法上的疏漏、專門法與國際法、普通法的銜接不流暢、法理上的沖突使特殊標志保護的理論有待完善、執(zhí)法成本控制不足造成政府資源和司法的浪費等。至此,通過對該選題的研究,了解當前我國奧林匹克標志的知識產(chǎn)權保護存在的困境,同時采取國際法與比較法的研究方法,調(diào)查研究國外關于奧林匹克標志知識產(chǎn)權保護的主,要法律和典型案例,在研究國際奧林匹克標志知識產(chǎn)權保護經(jīng)驗的基礎上,提出適時修改和完善我國《奧林匹克標志保護條例》的措施和建議。
[Abstract]:The Olympic Games is a sporting event all over the world. It involves not only sports, but also economy, culture and law. In the face of the huge business opportunities of the Olympic Games, merchants have thought to use this opportunity to publicize themselves, but if the way is improper, the infringement will occur, the most typical of which is to infringe the intellectual property rights of the Olympic logo. Since Beijing seized 199 cases of infringement of the Olympic logo in 2002, the infringement of the intellectual property rights of the Olympic logo has not only manifested itself in the direct infringement of the exclusive right of sale of the Olympic logo by illegal merchants. It also involves using hidden marketing to "scratch the edge" and encroach on the exclusive rights of Olympic partners. How to protect the legal rights of the holders of intellectual property rights of the Olympic symbols, safeguard the dignity of the Olympic Games and keep the purity of the Olympic spirit has become an urgent problem to be solved. The intellectual property protection of the Olympic logo does not exist in the first place. In the early days of the Olympic Games, because the systems were not perfect, the Olympic Games did not establish a fixed symbol, so there was no intellectual property protection of the Olympic logo products. After the Spanish man Samaranch took over as the IOC president in 1980, Carried out a series of radical reforms, formally introduced the Olympic Games into a new economic development model, and established the influential TOP program The Olympic Programme). This puts the protection of the Olympic logo on the agenda. The promulgation of the regulations on the Protection of the Olympic symbols in China marks the legal protection of the Olympic symbols. The regulations, which were promulgated by the State Council on February 4, 2002, came into effect on April 1 of the same year. So far the ninth anniversary of the implementation. This paper analyzes the property of the intellectual property rights of Olympic symbols in China and the present situation of domestic protection, and points out the limitations of the legal protection of Olympic symbols in China, which are manifested in the omission of special law, the special law and international law. The convergence of common law is not smooth, the conflict of legal principle makes the theory of special mark protection need to be perfected, and the insufficient control of law enforcement cost leads to the waste of government resources and judicature. So far, through the research on this topic, we can understand the dilemma of the intellectual property protection of the Olympic logo in our country at present, and at the same time adopt the research methods of international law and comparative law. To investigate and study the law and typical cases concerning the protection of intellectual property rights of Olympic symbols abroad, and on the basis of the study of the experience in the protection of intellectual property rights of international Olympic symbols, Measures and suggestions for timely revision and improvement of the regulations on the Protection of the Olympic symbols in China are put forward.
