【摘要】：在現(xiàn)代著作權(quán)保護(hù)制度確立之前,隨著最早發(fā)明于中國的印刷術(shù)的采用,中西方國家都曾出現(xiàn)過規(guī)范書籍出版和傳播的特殊管理制度。但是,為什么著作權(quán)法律制度首先在西方國家確立,而中國卻直至清末才在國際壓力下被動(dòng)地制定了歷史上第一部著作權(quán)法?致使中西方的著作權(quán)保護(hù)立法相差了近二百年的時(shí)間。追尋歷史和比較分析可以發(fā)現(xiàn),影響著作權(quán)保護(hù)制度確立的原因可以歸結(jié)為五大因素,其中,言論自由和出版商對(duì)自身利益的爭(zhēng)取是最主要的直接原因,而當(dāng)時(shí)的政治制度、經(jīng)濟(jì)發(fā)展水平和先進(jìn)思想理論傳播則是重要的基礎(chǔ)性因素。
[Abstract]:Before the establishment of the modern copyright protection system, with the adoption of the earliest invention of printing in China, there had been a special management system to regulate the publication and dissemination of books in the western countries. However, the legal system of copyright was first established in the western countries, and China was passively developed under international pressure until the end of the Qing Dynasty. The first copyright law in history has resulted in the difference between Chinese and Western copyright protection legislation for nearly two hundred years. The pursuit of history and comparative analysis can be found that the reasons for the establishment of the copyright protection system can be attributed to five major factors, of which the freedom of speech and the publisher's struggle for their own interests are the main direct causes. At that time, the political system, the level of economic development and the dissemination of advanced ideas and theories were important basic factors.
