【摘要】：隨著貿(mào)易區(qū)域化趨勢的增強和我國自貿(mào)試驗區(qū)的不斷建設(shè),一方面,自貿(mào)試驗區(qū)的建設(shè)為我國的貿(mào)易和投資提供了便利,另一方面,簡化的海關(guān)監(jiān)管規(guī)則導(dǎo)致往來貨物眾多,來源復(fù)雜,知識產(chǎn)權(quán)確權(quán)難度增大,普通區(qū)域里已存在的知識產(chǎn)權(quán)執(zhí)法效率不高、執(zhí)法爭議時間長等問題在自貿(mào)試驗區(qū)里更為突出,對我國自貿(mào)試驗區(qū)的健康發(fā)展存在著極大的不利影響。舟山自貿(mào)試驗區(qū)是我國大宗商品貿(mào)易及港口經(jīng)濟自貿(mào)試驗區(qū),其定位決定了海關(guān)在知識產(chǎn)權(quán)邊境保護時應(yīng)當(dāng)充分考慮其特殊性,為我國港口城市自貿(mào)試驗區(qū)海關(guān)知識產(chǎn)權(quán)邊境保護提供建議。同時,舟山自貿(mào)試驗區(qū)作為我國第三批自貿(mào)試驗區(qū)中東部經(jīng)濟區(qū)唯一的自貿(mào)試驗區(qū),其制度改革會對全國自貿(mào)試驗區(qū)的知識產(chǎn)權(quán)邊境保護建設(shè)探索提供有益經(jīng)驗。正是由于知識產(chǎn)權(quán)在邊境貿(mào)易中的重要性逐漸凸顯,本文首先對"自貿(mào)試驗區(qū)" "知識產(chǎn)權(quán)邊境保護"的深層次含義進行表述,然后再進行深入解讀知識產(chǎn)權(quán)邊境保護的重要意義。并在此基礎(chǔ)上通過分析現(xiàn)行自貿(mào)試驗區(qū)內(nèi)發(fā)生的糾紛指出現(xiàn)行自貿(mào)試驗區(qū)知識產(chǎn)權(quán)邊境保護的局限性。由于我國的自貿(mào)試驗區(qū)發(fā)展起步較晚,因此借鑒境內(nèi)外以發(fā)展港口經(jīng)濟、大宗貨物貿(mào)易的保護較為完善的發(fā)達地區(qū)和國家,為我國舟山自貿(mào)試驗區(qū)區(qū)的相關(guān)制度提供參考依據(jù)。
[Abstract]:With the increasing trend of trade regionalization and the continuous construction of China's free trade experimental area, on the one hand, the construction of the free trade test area has facilitated our trade and investment, on the other hand, the simplified customs supervision rules have led to a large number of goods. The sources are complex, the difficulty of confirming intellectual property rights becomes more difficult, the enforcement efficiency of intellectual property rights that already exists in ordinary regions is not high, and the problems such as the long time of law enforcement disputes are more prominent in the free trade experimental area. It has great adverse effect on the healthy development of our free trade test area. Zhoushan Free Trade Test area is a bulk commodity trade and port economy free trade experimental area in China. Its orientation determines that customs should fully consider its particularity when protecting the intellectual property border. To provide suggestions for the frontier protection of customs intellectual property rights in the port city free trade test area. At the same time, Zhoushan Free Trade Test Zone is the only free trade experimental area in the economic zone of the middle and eastern part of the third free trade experimental area in China. The reform of its system will provide beneficial experience for the frontier protection of intellectual property rights in the national free trade experimental area. It is precisely because the importance of intellectual property rights in border trade is gradually becoming prominent that this paper first describes the deep meaning of "free trade test area" and "intellectual property border protection". After that, the importance of intellectual property border protection is explained in depth. On this basis, the limitations of intellectual property rights border protection in the current free trade test area are pointed out by analyzing the disputes in the current free trade test area. Since the development of our country's free trade test area started late, the developed regions and countries that developed port economy and the protection of bulk goods trade are used for reference to provide reference basis for the related system of Zhoushan free trade test area in our country.
