【摘要】：親子鑒定具有倫理的特殊性,而不是單純生物學(xué)上的科技手段,親子鑒定的結(jié)果涉及身份關(guān)系的爭議、婚姻家庭關(guān)系的和諧,因此如何適用親子鑒定來調(diào)整親子關(guān)系成為不容忽視的法律問題。本文結(jié)合實(shí)際案例進(jìn)行說明,分析我國親子鑒定在調(diào)整親子關(guān)系中所面臨的問題。指出真實(shí)的親子關(guān)系之下還蘊(yùn)含著社會倫理和社會價(jià)值,血緣真實(shí)主義確定親子關(guān)系時(shí)存在著限制。對在親子關(guān)系法中合理適用親子鑒定提出了一些建議。文章第一部分是問題的提出,該部分通過一個(gè)運(yùn)用親子鑒定的案例的引入,對現(xiàn)狀中親子鑒定廣泛應(yīng)用引起的社會問題提出思考。文章第二部分通過血緣上的親子關(guān)系和法律上親子關(guān)系的分析,指出存在血緣真實(shí)性與法律真實(shí)性沖突的情況,提出親子關(guān)系可以確認(rèn)真實(shí)的血緣關(guān)系,但不一定能解決實(shí)際的親子關(guān)系,強(qiáng)調(diào)血緣主義確定親子關(guān)系的限制,對第一部分的問題的根源進(jìn)行了探討,只有明確問題產(chǎn)生的原因之后,才能更好地解決問題。文章第三部分是緊接第二部分,通過分析在親子關(guān)系中適用親子鑒定意見對法律關(guān)系的影響及法律沖突,進(jìn)一步明確適用親子鑒定的限制,我們應(yīng)當(dāng)允許法律真實(shí)性與客觀真實(shí)性存在一定的差距。文章第四部分是通過對我國及其它各國親子關(guān)系法中親子鑒定的現(xiàn)狀的分析,對我國親子鑒定的發(fā)展作了一些啟示性的建議,也是對前面第一部分問題提出的解決。在運(yùn)用親子鑒定處理親子關(guān)系的紛爭中,應(yīng)當(dāng)合理適用親子鑒定,盡量使血統(tǒng)的真實(shí)性與身份關(guān)系的安定性兩種法益實(shí)現(xiàn)平衡。在兼顧父母利益和子女利益的同時(shí),要將未成年人利益的保護(hù)放在首位,保護(hù)婚姻、家庭的穩(wěn)定,身份的安定性。如此親子關(guān)系法中的親子鑒定在才能得到更完善的發(fā)展。
[Abstract]:Paternity testing has ethical particularity, but not purely biological scientific and technological means. The result of paternity test involves the controversy of identity relationship, the harmony of marriage and family relationship, Therefore, how to apply paternity test to adjust the relationship between parents and children has become a legal problem that can not be ignored. This paper analyzes the problems faced by paternity testing in adjusting parent-child relationship in China. It is pointed out that there are social ethics and social values under the real parent-child relationship, and there are limitations in the determination of parent-child relationship by consanguinity truthism. Some suggestions on the reasonable application of paternity test in parent-child relationship law are put forward. The first part of the article is the question of the introduction of a case of paternity testing, to the current situation of parentage test caused by the widespread application of social problems. In the second part, through the analysis of parent-child relationship and legal parent-child relationship, the author points out that there is a conflict between the authenticity of blood relationship and legal authenticity, and points out that parent-child relationship can confirm the true blood relationship. However, it does not necessarily solve the actual parent-child relationship, emphasizing the limitation of parent-child relationship determined by consanguinity, and probes into the root of the problem in the first part. Only when the causes of the problem are clear, can the problem be solved better. The third part of the article is the second part, through the analysis of the application of paternity testing opinion on the legal relationship and conflict of laws, further clear the application of paternity testing restrictions. We should allow a certain gap between legal authenticity and objective authenticity. The fourth part of the article is to analyze the status quo of paternity testing in China and other countries, and make some enlightening suggestions on the development of paternity testing in China, which is also the solution to the first part of the problem. In the use of paternity testing to deal with disputes between parents and children, it is necessary to apply parent-child testing reasonably and to balance the authenticity of lineage with the stability of identity relationship as far as possible. While taking into account the interests of parents and children, we should put the protection of the interests of minors in the first place to protect the stability of marriage, the family and the stability of identity. So the paternity test in the parent-child relationship method can get more perfect development.
