【摘要】：隨著互聯(lián)網(wǎng)的不斷發(fā)展,個(gè)人隱私信息變得更加容易被獲取、利用,使個(gè)人隱私置于“暴露”的狀態(tài)之中,時(shí)刻存在著被人偷窺、泄露的可能性,讓人防不勝防,最后因個(gè)人隱私被不受控制的知悉而陷入困境,甚至造成不可挽回的局面。大數(shù)據(jù)時(shí)代,網(wǎng)絡(luò)隱私權(quán)的保護(hù)上升到一個(gè)前所未有的高度重視的位置。為保護(hù)公民網(wǎng)絡(luò)隱私權(quán),維護(hù)正常的網(wǎng)絡(luò)生活秩序,要求對(duì)網(wǎng)絡(luò)隱私權(quán)進(jìn)行立法的呼聲越來(lái)越高。美國(guó)關(guān)于網(wǎng)絡(luò)隱私權(quán)的保護(hù),因其自身的法律傳統(tǒng)以及重視自由的理念,美國(guó)更加注重通過(guò)行業(yè)自律來(lái)對(duì)網(wǎng)絡(luò)隱私權(quán)進(jìn)行保護(hù)。而歐盟傾向立法模式保護(hù)網(wǎng)絡(luò)隱私,歐盟主張依靠法律規(guī)制網(wǎng)絡(luò)用戶的網(wǎng)絡(luò)行為以達(dá)到保護(hù)個(gè)人的網(wǎng)絡(luò)隱私的目的。研究國(guó)外網(wǎng)絡(luò)隱私權(quán)的保護(hù),對(duì)我國(guó)網(wǎng)絡(luò)隱私權(quán)的保護(hù)制度具有十分重要的借鑒意義。第一部分,是對(duì)網(wǎng)絡(luò)隱私權(quán)的基本理論的闡述,以及研究我國(guó)網(wǎng)絡(luò)隱私權(quán)民法保護(hù)的相關(guān)法律規(guī)定和對(duì)現(xiàn)實(shí)問(wèn)題的分析。第二部分,研究國(guó)外主要是歐美國(guó)家的網(wǎng)絡(luò)隱私權(quán)保護(hù)模式的選擇及其利弊分析,同時(shí)研究歐美國(guó)家對(duì)網(wǎng)絡(luò)隱私權(quán)民法保護(hù)上的相關(guān)規(guī)定,借鑒其優(yōu)秀經(jīng)驗(yàn)以完善我國(guó)網(wǎng)絡(luò)隱私權(quán)的保護(hù)。第三部分,借鑒國(guó)外網(wǎng)絡(luò)隱私權(quán)的保護(hù),提出完善我國(guó)網(wǎng)絡(luò)隱私權(quán)保護(hù)的相關(guān)建議。
[Abstract]:With the continuous development of the Internet, personal privacy information becomes more easily access, use, so that personal privacy in the "exposed" state, there is always the possibility of being peeped, leaked, so that people can not prevent, Finally, personal privacy is out of control, even irreparable. In the era of big data, the protection of network privacy has risen to a position of unprecedented attention. In order to protect citizens' right to network privacy and maintain the normal order of network life, the voice of legislating the right of network privacy is becoming higher and higher. Because of its own legal tradition and the concept of attaching importance to freedom, the United States pays more attention to the protection of network privacy through industry self-discipline. The EU tends to protect the network privacy by legislation mode, and the EU advocates to rely on the law to regulate the network behavior of the network users in order to achieve the purpose of protecting the personal network privacy. It is of great significance to study the protection of network privacy in foreign countries. The first part is the elaboration of the basic theory of network privacy, as well as the study of the relevant legal provisions of the civil law protection of network privacy and the analysis of practical problems. The second part studies the choice of network privacy protection mode and its advantages and disadvantages in Europe and the United States. At the same time, it studies the relevant provisions of the civil law protection of network privacy in Europe and the United States. Learn from its excellent experience in order to improve the protection of the right to network privacy. The third part, draw lessons from the protection of foreign network privacy, put forward the relevant suggestions to improve the protection of network privacy in China.
