【摘要】：由于現(xiàn)代科學技術(shù)的迅猛發(fā)展,使我們?nèi)粘Ｉ钤絹碓椒奖�、快�?逐漸擴寬了人們生活的領(lǐng)域,同時也逐漸影響且改變了一般人的社會生活方式,并帶來了新的社會議題,如個人數(shù)據(jù)保護,而且愈演愈烈,已經(jīng)演變成我們不得不去面對的問題,如收集個人信息有何不對?是支持信息自由流通還是個人信息保護等等。在我國2017年3月15日出臺《民法總則》中,增加了對個人數(shù)據(jù)的保護,也體現(xiàn)了國家對此的重視,但該部分或許并不能夠滿足社會發(fā)展的需要,借鑒世界一些先進國家和地區(qū)的經(jīng)驗,還是要制定和頒布一部專門的個人數(shù)據(jù)保護的法律。基于此,本文試圖在新出臺的《民法總則》中對個人數(shù)據(jù)規(guī)定的基礎(chǔ)上,作如下研究:首先界定“個人信息”與“個人數(shù)據(jù)”的概念與關(guān)系,從各國的角度出發(fā)對其進行辨析,此為本文第一步;其次闡述個人數(shù)據(jù)保護問題的產(chǎn)生原因(包括我們現(xiàn)實生活中實際存在的一些問題)與我國的立法現(xiàn)狀;再次,在我國目前的立法現(xiàn)狀之上,探究個人數(shù)據(jù)保護的法理基礎(chǔ)以及侵權(quán)責任如何認定;再次,列舉在保護個人數(shù)據(jù)的同時可能存在的權(quán)利沖突以及化解該沖突的原則。最后,對我國個人數(shù)據(jù)保護的立法提一些構(gòu)想。
[Abstract]:With the rapid development of modern science and technology, our daily life has become more and more convenient and fast, and gradually broadened the scope of people's life, but also gradually affected and changed the social life style of ordinary people, and brought about new social issues. If personal data protection, and increasingly, has become a problem we have to face, such as the collection of personal information what is wrong? Is to support the free flow of information or personal information protection and so on. The introduction of the General principles of Civil Law on March 15, 2017 in our country has increased the protection of personal data and reflected the importance that the state attaches to it, but this part may not be able to meet the needs of social development. Drawing on the experience of some advanced countries and regions in the world, we should make and promulgate a special personal data protection law. Based on this, this paper tries to do the following research on the basis of the personal data stipulation in the newly published General principles of Civil Law: firstly, it defines the concept and relationship between "personal information" and "personal data", and analyzes them from the point of view of each country. This is the first step of this paper; secondly, the causes of personal data protection problems (including some problems in our real life) and the status of legislation in China are expounded. Thirdly, on the basis of the current legislative situation of our country, Explore the legal basis of personal data protection and how to determine the tort liability; thirdly, enumerate the possible conflict of rights while protecting personal data and the principles to resolve the conflict. Finally, some ideas about the legislation of personal data protection in our country are put forward.
