【摘要】：移動互聯(lián)網(wǎng)是當前互聯(lián)網(wǎng)產(chǎn)業(yè)發(fā)展中相當重要的,兼具社交和媒體屬性的網(wǎng)絡產(chǎn)業(yè)形態(tài)。近年來,隨著移動互聯(lián)網(wǎng)應用終端科技含量的不斷提高,移動終端的功能也變得更加人性和精準。人們在工作和生活中對移動互聯(lián)網(wǎng)的需求越來越高,移動智能終端也變得越來越重要。但是,在移動互聯(lián)網(wǎng)的發(fā)展日新月異的同時,數(shù)字內(nèi)容的版權保護在網(wǎng)絡產(chǎn)業(yè)發(fā)展中的地位也變得越來越重要。隨著網(wǎng)絡侵權問題的不斷惡化,數(shù)字內(nèi)容的版權問題很可能會成為移動互聯(lián)網(wǎng)產(chǎn)業(yè)停滯不前,甚至前功盡棄的主要因素。一方面,在移動互聯(lián)網(wǎng)環(huán)境下,數(shù)字內(nèi)容的侵權現(xiàn)象越演越烈,并且已經(jīng)嚴重阻礙了互聯(lián)網(wǎng)行業(yè)的正常發(fā)展,影響了網(wǎng)絡版權文化產(chǎn)業(yè)前進的腳步;另一方面,移動互聯(lián)網(wǎng)相關企業(yè)已經(jīng)意識到版權保護在產(chǎn)業(yè)發(fā)展中的重要性,并在運營模式和技術應用上進行了改進和完善。但是由于國內(nèi)移動互聯(lián)網(wǎng)的整體運營模式還不成熟,技術應用手段落后,加之各種因素交錯復雜,網(wǎng)絡版權問題并未從根本上得到解決。在對移動互聯(lián)網(wǎng)的版權進行保護的過程中,大多數(shù)企業(yè)根本沒有認識到一個健康的行業(yè)秩序和體制的建立,僅靠一家之力是無法完成的。網(wǎng)絡公司個體必須聯(lián)合行業(yè)內(nèi)其他具有相同志向和需求的企業(yè),在政府部門的監(jiān)管和支持下,集結(jié)全社會的力量,才能在具體實踐中探索出一條合理高效的版權保護之路。本論文從移動互聯(lián)網(wǎng)的概念、發(fā)展歷程、發(fā)展現(xiàn)狀和發(fā)展特性入手,立足于前人的研究成果,旨在通過深入研究移動互聯(lián)網(wǎng)發(fā)展現(xiàn)狀,總結(jié)網(wǎng)絡經(jīng)濟健康發(fā)展的相關理論和方法,并從傳播學和經(jīng)濟學的角度分析當前移動互聯(lián)網(wǎng)版權保護存在的問題和瓶頸。通過對國內(nèi)外版權保護的經(jīng)典案例進行比較分析,總結(jié)國內(nèi)外在移動互聯(lián)網(wǎng)版權運營中的有益經(jīng)驗,并針對國內(nèi)版權保護的具體問題提出一套“版權保護機制”,即構(gòu)建“移動互聯(lián)網(wǎng)版權生態(tài)鏈”模型。最后將運用“利益相關者”的分析方法,從法律法規(guī)、政策監(jiān)管、運營模式和技術應用幾個方面,對我國移動互聯(lián)網(wǎng)的版權保護機制構(gòu)建提出應對策略。
[Abstract]:Mobile Internet is an important network industry with both social and media attributes in the current development of the Internet industry. In recent years, with the development of mobile Internet application terminal technology, the function of mobile terminal has become more human and accurate. With the increasing demand for mobile Internet in work and life, mobile intelligent terminals are becoming more and more important. However, with the rapid development of mobile Internet, copyright protection of digital content has become more and more important in the development of network industry. With the deterioration of network infringement, the copyright of digital content is likely to become the main factor of the stagnation of mobile Internet industry and even the abandonment of its previous efforts. On the one hand, in the mobile Internet environment, the phenomenon of digital content infringement is becoming more and more intense, and has seriously hindered the normal development of the Internet industry, which has affected the progress of the network copyright culture industry; on the other hand, Mobile Internet related enterprises have realized the importance of copyright protection in the development of industry, and have improved and perfected the operation mode and technology application. But because the whole operation mode of domestic mobile Internet is not mature, the technical application means is backward, and various factors are interlaced and complicated, the problem of network copyright has not been solved fundamentally. In the process of protecting the copyright of mobile Internet, most enterprises do not realize the establishment of a healthy industry order and system. In order to explore a reasonable and efficient way of copyright protection in practice, Internet companies must unite with other enterprises with the same aspirations and needs, and muster the strength of the whole society under the supervision and support of government departments. This paper starts with the concept, development history, development status and characteristics of mobile Internet, based on the previous research results, aiming at the development of mobile Internet through in-depth research. This paper summarizes the relevant theories and methods of the healthy development of the network economy, and analyzes the existing problems and bottlenecks of the copyright protection of the mobile Internet from the angle of communication and economics. Through the comparative analysis of the classic cases of copyright protection at home and abroad, this paper summarizes the beneficial experience in the copyright operation of mobile Internet at home and abroad, and puts forward a set of "copyright protection mechanism" aiming at the specific problems of domestic copyright protection. That is to build the model of "Mobile Internet copyright Ecological chain". Finally, by using the method of "stakeholder" analysis, this paper puts forward some countermeasures for the construction of copyright protection mechanism of mobile Internet in China from the aspects of laws and regulations, policy supervision, operation mode and technology application.
