【摘要】：孤兒作品是指作品在著作權(quán)保護(hù)期限內(nèi),潛在作品使用人經(jīng)過(guò)努力勤勉的尋找,仍然無(wú)法找到著作權(quán)權(quán)利人的作品�；ヂ�(lián)網(wǎng)技術(shù)的普及與廣泛應(yīng)用,數(shù)字化圖書(shū)館建設(shè),從根本上轉(zhuǎn)變了作品的傳播方式,改變了作品以實(shí)體為載體,以復(fù)制、發(fā)行為主要傳播方式的傳統(tǒng)作品傳播方式。作品創(chuàng)作主體走向草根化,作品創(chuàng)作完成后,通過(guò)互聯(lián)網(wǎng)廣泛而迅速的傳播,使孤兒作品問(wèn)題更加突出。平衡孤兒作品潛在使用者與孤兒作品著作權(quán)人之間的利益,構(gòu)建符合知識(shí)產(chǎn)權(quán)國(guó)際公約、著作權(quán)法基本原理,以及本國(guó)司法實(shí)踐的孤兒作品著作權(quán)保護(hù)制度,推動(dòng)與促進(jìn)文化的交流與廣泛傳播是擺在各個(gè)國(guó)家關(guān)于孤兒作品著作權(quán)保護(hù)制度設(shè)計(jì)面前的難題。我國(guó)現(xiàn)行立法制度缺乏對(duì)孤兒作品著作權(quán)保護(hù)完整設(shè)計(jì),并不能很好的解決司法實(shí)踐中遇見(jiàn)的孤兒作品問(wèn)題,使孤兒作品使用者對(duì)于作品的利用處于兩難境地,擅自利用作品將可能構(gòu)成侵權(quán),放棄利用作品將無(wú)法完成自身的創(chuàng)作。導(dǎo)致孤兒作品潛在使用者與孤兒作品著作權(quán)人之間利益失衡,不利于文化的交流與廣泛的傳播。構(gòu)建符合國(guó)際知識(shí)產(chǎn)權(quán)公約、著作權(quán)基本原理、以及我國(guó)司法實(shí)踐的孤兒作品著作權(quán)保護(hù)制度具有現(xiàn)實(shí)性與緊迫性。本文分為四個(gè)部分:第一部分,分析孤兒作品的定義、特征,以孤兒作品使用者與孤兒作品著作權(quán)人為基本角度對(duì)孤兒作品進(jìn)行分類(lèi)。并從法律原因以及非法律原因兩個(gè)層面分析孤兒作品產(chǎn)生的原因。第二部分,采用案例分析的研究方法,系統(tǒng)整理數(shù)字化環(huán)境下及非數(shù)字環(huán)境下孤兒作品典型的國(guó)內(nèi)外案例,進(jìn)一步認(rèn)知孤兒作品保護(hù)的必要性及緊迫性,為孤兒作品著作權(quán)保護(hù)制度的構(gòu)建作出鋪墊。第三部分,采用比較法研究的方法,比較與研究世界主要國(guó)家和地區(qū)孤兒作品著作權(quán)保護(hù)的法律規(guī)定,并分析他們的優(yōu)勢(shì)及不足,為我國(guó)孤兒作品著作權(quán)保護(hù)制度的構(gòu)建提供參考。第四部分,立足于前文,分析我國(guó)孤兒作品立法現(xiàn)狀及《著作權(quán)法(修改草案)》對(duì)孤兒作品著作權(quán)保護(hù)制度的規(guī)定,綜合借鑒國(guó)外孤兒作品立法經(jīng)驗(yàn),確立孤兒作品著作權(quán)保護(hù)立法模式選擇的基本原則。力求尋找符合國(guó)際知識(shí)產(chǎn)權(quán)公約、著作權(quán)法基本原理,以及我國(guó)司法實(shí)踐的孤兒作品保護(hù)制度。提出自己對(duì)孤兒作品著作權(quán)保護(hù)制度構(gòu)建及輔助性措施的淺見(jiàn)。
[Abstract]:Orphan works refer to the works in the copyright protection period, the potential users of works through hard work, still can not find the copyright owner of the work. The popularization and wide application of Internet technology and the construction of digital library have fundamentally changed the mode of dissemination of works, and changed the traditional ways of dissemination of works in which entity is the carrier, reproduction and distribution are the main modes of communication. After the creation of the works, they spread widely and rapidly through the Internet, which made the problem of orphans' works more prominent. Balancing the interests between potential users of orphan works and copyright owners of orphan works, establishing a copyright protection system for orphan works in line with the international convention on intellectual property rights, the basic principles of copyright law, and the judicial practice in our country, To promote and promote cultural exchange and wide dissemination is a difficult problem in the design of copyright protection system of orphan works in various countries. China's current legislative system lacks a complete design to protect the copyright of orphan works, which can not solve the problem of orphans' works in judicial practice and make the users of orphan works in a dilemma. Unauthorized use of works may constitute an infringement, giving up the use of works will not be able to complete their own creation. It leads to the imbalance between the interests of the potential users of the orphan works and the copyright owners of the orphan works, which is not conducive to the cultural exchange and widespread dissemination. It is realistic and urgent to construct the copyright protection system of orphan works, which accords with the international intellectual property rights convention, the basic principle of copyright and the judicial practice of our country. This paper is divided into four parts: the first part analyzes the definition and characteristics of orphan works and classifies orphan works from the perspective of the users of orphan works and the copyright owners of orphan works. And from the legal reasons and non-legal reasons to analyze the causes of orphans. The second part, using the method of case analysis, systematically arranges the typical domestic and foreign cases of orphans' works in digital environment and non-digital environment, and further recognizes the necessity and urgency of the protection of orphans' works. It lays the foundation for the construction of the copyright protection system of orphan works. The third part, using the method of comparative study, compares and studies the legal provisions of the copyright protection of orphan works in major countries and regions of the world, and analyzes their advantages and disadvantages. To provide reference for the construction of copyright protection system of orphan works in China. The fourth part, based on the above, analyzes the current legislative situation of orphans' works in China and the provisions of copyright Law (revised draft) on the copyright protection system of orphans' works, and draws on the legislative experience of foreign orphans' works synthetically. To establish the basic principles of legislative mode selection for the copyright protection of orphan works. To seek for the protection system of orphans' works in accordance with the international intellectual property rights convention, the basic principles of copyright law and the judicial practice of our country. The author puts forward his own views on the construction of copyright protection system of orphan works and the auxiliary measures.
