【摘要】
中國民法近代化以西方近代民法所體現(xiàn)的人格平等、私權(quán)神圣、契約自由、過錯責任等私法原則為模范,同時也根據(jù)西方近代民法適應(yīng)技術(shù)進步、社會發(fā)展在私法原則方面的變化,調(diào)整自身內(nèi)容。中國近代民法的演進,基于西方近代民法從個人本位到社會本位的變化,確定了一條從傳統(tǒng)的家庭本位走捷徑過渡到社會本位的路線,對于中國近代民法和中國近代社會,均產(chǎn)生重要影響。

The modernization of Chinese civil law generally follows the Western modern law, adopting its principles of equal personality, holy private right, contract autonomy and fault liability as our models. Meanwhile, it adjusts these principles, following changes of Western modern law which happened with the development of technology and society.
