【摘要】：抵押權(quán)順位制度是《物權(quán)法》中抵押權(quán)的重要組成部分。抵押權(quán)的順序?yàn)榈盅喝讼嗷ブg的關(guān)系,為抵押權(quán)在實(shí)現(xiàn)上的排他效力的重要表現(xiàn),反映了立法者對(duì)抵押權(quán)制度的理解和設(shè)計(jì),以及希望該制度在現(xiàn)實(shí)的經(jīng)濟(jì)生活和金融交易發(fā)揮怎樣的功能。文章分析了抵押權(quán)順位相關(guān)法律問題,包括抵押權(quán)順位的實(shí)現(xiàn)、順位固定主義和升進(jìn)主義的區(qū)分,以及順位拋棄、變更和轉(zhuǎn)讓等,通過對(duì)德國(guó)等相關(guān)制度的闡述和分析,就我國(guó)的抵押權(quán)順位制度設(shè)計(jì)提出相應(yīng)的法律建議。
[Abstract]:Mortgage ranking system is an important part of mortgage in Real right Law. The order of mortgage is the relationship between mortgagors and the important manifestation of exclusive effect of mortgage in realization, which reflects the understanding and design of mortgage system by legislators. And the hope that the system in real economic life and financial transactions play a role. This paper analyzes the legal problems related to the ranking of mortgage, including the realization of the right of mortgage, the distinction between the doctrine of ranking and advancing, and the abandonment, alteration and transfer of the right of mortgage, and through the elaboration and analysis of the relevant systems such as Germany, etc. This paper puts forward the corresponding legal suggestions on the design of the system of mortgage ranking in our country.
