【摘要】：小產(chǎn)權(quán)房買賣合法化是大勢所趨。相關(guān)法律政策對小產(chǎn)權(quán)房買賣持禁止的態(tài)度,但小產(chǎn)權(quán)房的交易近年來卻是以有增無減的勁頭發(fā)展,因為城市化進程的土地?zé)o從獲取,集體土地?zé)o疑能夠有效地解決大量涌進城市人們的住房問題。為保護農(nóng)用地而限制集體土地使用權(quán)的交易本無可厚非,而集體土地只能轉(zhuǎn)為國有土地,只能坐等國家廉價征收作為唯一途徑,讓這種土地制度設(shè)計喪失了正當(dāng)性。文章開篇先大致闡述小產(chǎn)權(quán)房的基本情況,分為兩個方面來寫:第一,概念和類別,厘清本文具體要討論的哪些小產(chǎn)權(quán)房。第二,法律法規(guī)對小產(chǎn)權(quán)房調(diào)控的演變和現(xiàn)有小產(chǎn)權(quán)房的規(guī)模,說明小產(chǎn)權(quán)房在現(xiàn)實生活中的影響,法律對其的態(tài)度變化。繼而描述審判實踐中對小產(chǎn)權(quán)房買賣問題的處理,為下文的討論作進一層的鋪墊。首先從著名的“畫家村”案入手,介紹小產(chǎn)權(quán)房的審理過程中還是有很多爭議的。接著分別介紹北京和上海兩個地方對于小產(chǎn)權(quán)房買賣案件的典型性處理,可以看出還是有很多不同的地方。再者進入本文核心,著力于小產(chǎn)權(quán)房買賣合法化的可行性分析:第一,對小產(chǎn)權(quán)房的規(guī)定上法律和政策上的不和諧,很大程度上導(dǎo)致了國有土地與集體土地的不平等;第二,從私有財產(chǎn)自由處分的角度來講,限制小產(chǎn)權(quán)房的交易不合理;第三,綜合英國和美國土地使用政策的考量,國家應(yīng)該重視保護土地的使用權(quán),政府不與民爭富。文章的最后部分給出了一些對現(xiàn)有已經(jīng)交易的小產(chǎn)權(quán)房處理辦法,以保障將來小產(chǎn)權(quán)房買賣合法化能順利進行。
[Abstract]:The legalization of small property right houses is the trend of the times. The relevant laws and policies prohibit the sale and purchase of small property houses, but in recent years the transaction of small property houses has been growing unabated, because the land in the process of urbanization is not available. There is no doubt that collective land can effectively solve the housing problem of a large number of urban people. The transaction of restricting collective land use right in order to protect agricultural land is not to blame, and collective land can only be converted into state-owned land, and can only wait for the national cheap expropriation as the only way to make the design of this land system lose its legitimacy. At the beginning of the article, the basic situation of the small property right room is described, which is divided into two aspects: first, the concept and the category, and clarify which small property right house to discuss in this paper. Second, the evolution of laws and regulations on the regulation and control of small property houses and the scale of existing small property houses, which shows the impact of small property houses in real life, and the change of the attitude of the law towards them. Then it describes how to deal with the sale and purchase of small property houses in trial practice, which lays the groundwork for the discussion below. First of all, from the famous "painting Village" case, the introduction of small property rights in the trial process is still a lot of controversy. Then it introduces the typical handling of small property right housing cases in Beijing and Shanghai, which shows that there are still many different places. Furthermore, into the core of this paper, we focus on the feasibility analysis of legalizing the sale and purchase of small property houses. First, the disharmony between laws and policies on the regulation of small property houses leads to the inequality between state-owned land and collective land to a great extent; second, From the angle of free disposition of private property, it is unreasonable to restrict the transaction of small property right house. Third, considering the land use policy of Britain and America, the state should pay attention to protecting the right to use land, and the government should not compete with the people for wealth. In the last part of the paper, some methods of dealing with the existing small property houses are given to ensure that the legalization of the purchase and sale of small property houses can proceed smoothly in the future.
